AN ACT concerning

Evidence — Chemical Tests for Intoxication

FOR the purpose of permitting a person to request a
chemical test for intoxication if one has not been
offered by the police officer.

BY repealing and re—enacting, with amendments.

Article — Courts and Judicial Proceedings
Section 10-304(d)
Annotated Code of Maryland
(1974 Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 10-304(d) of Article- Courts and
Judicial Proceedings, of the Annotated Code of Maryland
(1974 Volume) be and it is hereby repealed and
re—enacted, with amendments, to read as follows:

Article - Courts and Judicial Proceedings
10-304.

(d) The person tested is permitted to have a
physician of his own choosing administer a chemical test
in addition to the one administered at the direction of
the police officer[.], AND IN THE EVENT NO TEST IS
OFFERED OR REQUESTED BY THE POLICE OFFICER, THE PERSON
MAY REQUEST, AND THE OFFICER SHALL HAVE ADMINISTERED, ONE
OF THE CHEMICAL TESTS PROVIDED FOR IN THIS SECTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
