(5) Any word, statement, or other information,
required to appear on the label or labeling, is not
placed on it prominently and conspicuously, as compared
with other words, statements, designs, or devices in the
labeling, and it is not in terms that render it likely to
be read and understood by the ordinary individual under
customary conditions of purchase and use.

[ (m) ] (N) "Percent" or "percentage" means percentage
by weight.

[(n)] (O) "Ton" means a net weight of two thousand
pounds avoirdupois.

6-107.

(a) A person shall register each commercial feed,
except customer-formula feed and contract feed, before
distributing it in the State.

(B) A PERSON SHALL REGISTER EACH CUSTOMER-FORMULA
FEED MANUFACTURING FACILITY AND [EACH]] IF A PERSON HAS
TWO OR MORE PORTABLE CUSTOMER-FORMULA FEED {[MIXER,
EXCEPT A MIXER OWNED AND OPERATED BY A PERSON SOLELY FOR
HIS OWN USE AND NOT FOR THE SALE OR DISTRIBUTION OF
CUSTOMER-FORMULA FEED TO OTHERS, BEFORE MANUFACTURING
CUSTOMER-FORMULA FEEDS IN THE STATE]] MIXERS, HE SHALL
REGISTER EACH MIXER.

[(b)] (C) The registration application FOR
COMMERCIAL FEEDS shall be submitted on forms furnished by
the Secretary, and shall also be accompanied by a label
or other printed matter describing the product if
requested by the Secretary. The application shall
include the information required by §§ 6—109, 6—110, and
6-111. THE REGISTRATION APPLICATION FOR CUSTOMER-FORMULA
FEED MANUFACTURING FACILITIES AND PORTABLE
CUSTOMER-FORMULA FEED MIXERS SHALL BE SUBMITTED ON FORMS
FURNISHED BY THE SECRETARY, AND SHALL INCLUDE THE
APPLICANT'S NAME, PLACE OF BUSINESS, LOCATION OF EACH
FACILITY, AND SUCH OTHER INFORMATION AS THE SECRETARY BAY
PRESCRIBE. When the Secretary has approved the
registration, he shall furnish a copy to the applicant.

[(c)] (D) The annual registration fee for each
commercial feed distributed in the State is $20.
Customer—formula feeds and contract feeds are exempt if
the registration fee is paid on the commercial feeds
which they contain. In addition, any distributor shall
pay an annual registration fee of $25 for each brand of
commercial feed distributed in individual packages of ten
pounds or less. THE ANNUAL REGISTRATION FEE FOR EACH
NON-PORTABLE CUSTOMER-FORMULA FEED MANUFACTURING FACILITY
IN THE STATE IS $100. THE ANNUAL REGISTRATION FEE FOR
