2820                                         LAWS OF MARYLAND                     [Ch. 850

400A.

In Allegany and Washington counties, it shall be
unlawful for any person under the age of twenty—one (21)
years to have in his possession, or under his charge or
control, any alcoholic beverage OTHER THAN BEER OR LIGHT
WINE as defined in Article 2B of the Annotated Code of
Maryland, AND ANY PERSON UNDER EIGHTEEN YEARS TO HAVE
SEER OR LIGHT WINE, unless such person shall then and
there be a bona fide employee of a license holder, as
defined in the said Article 2B, and shall then and there
have in his possession, or under his charge or control,
such alcoholic beverage during regular working hours and
in the course of his or her employment.

Any person under the age of twenty-one (21) years
violating the provisions of this subtitle shall be deemed
guilty of a misdemeanor, and, upon a conviction thereof
in any court of competent jurisdiction, shall be
sentenced to pay a fine of not less than $25.00 nor more
than $100.00 or imprisoned in jail for a period not
exceeding ten days or both fined and imprisoned in the
discretion of the court. Any such person who is under
the age of 18 years shall be within the jurisdiction of
the juvenile courts of the said counties.

Any person who obtains any spirituous or fermented
liquors from any other person licensed to sell the same
for any minor or person under twenty—one years of age,
except that fin Montgomery and Prince George's counties]
the age shall be eighteen years for beer or light wine,
knowing him to be such, to be drunk by said minor or
person under twenty—one years of age, except that [in
Montgomery and Prince George's counties] the age shall be
eighteen years for beer or light wine, shall be deemed
guilty of a misdemeanor, and upon conviction thereof
shall be fined not less than twenty dollars nor more than
fifty dollars, or imprisoned in jail for not less than
thirty days nor more than ninety days, or be both fined
and imprisoned in the discretion of the court.

402.

Any person who shall knowingly, wilfully or falsely
represent to any licensed innkeeper, restaurant keeper or
other person or persons engaged in the sale of
intoxicating liquors, THE FALSE AGE OF ANY PERSON [any
minor to be of full age] for the purpose of inducing any
[such] licensed innkeeper, restaurant keeper or other
person or persons engaged in the sale of intoxicating
liquors to ILLEGALLY sell or furnish any intoxicating
liquors to [said minors] ANY PERSON [shall be deemed] IS
