SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 78A be and it is hereby added
to the Public Local Laws of Charles County being Article
9 of the Code of Public Local Laws of Maryland (1969
Edition and 1972 Supplement,) to read as follows:

Article 9
78A.

(A)    THE COUNTY COMMISSIONERS OF CHARLES COUNTY
MAY, BY ORDINANCE OR RESOLUTION, PROVIDE FOR THE
ABOLITION OF ANY WATER OR SEWER AUTHORITY CREATED BY THE
COUNTY COMMISSIONERS PURSUANT TO THE PROVISIONS OF
SECTION 445 THROUGH 466 OF ARTICLE 43 OF THE ANNOTATED
CODE OF MARYLAND AND THE ABOLITION OF ANY DISTRICT
CREATED PURSUANT TO THE PROVISIONS OF SECTION 545 THROUGH
673 OF ARTICLE 43 Of THE ANNOTATED CODE OF MARYLAND.
HOWEVER:

(1) ABOLITION MAY IN NO WAY IMPAIR OR AFFECT
THE VALIDITY OR ENFORCEABILITY OF ANY PROCEEDING OR
ACTION TAKEN, OR ANY OBLIGATIONS OR INDEBTEDNESS INCURRED
BY THE AUTHORITY OR DISTRICT OR ITS GOVERNING BODY PRIOR
TO THE EFFECTIVE DATE OF THE ABOLISHING ORDINANCE OR
RESOLUTION;

(2)    ALL EXISTING OBLIGATIONS (WHETHER BONDED
INDEBTEDNESS OR OTHERWISE) OF THE AUTHORITY OR DISTRICT
SHALL DEVOLVE UPON, AND BE ASSUMED BY, THE COUNTY
COMMISSIONERS BY OPERATION OF THIS SECTION OF THIS CODE;
AND

(3)     A COPY OF THE ORDINANCE OR RESOLUTION
SHALL BE FILED WITH THE STATE DEPARTMENT OF ASSESSMENTS
AND TAXATION WHICH SHALL RECEIVE THEN AND ENDORSE ON THE
COPY THE DATE AND TIME OF RECEIPT.

UPON RECEIPT OF THE ORDINANCE OR RESOLUTION BY THE
STATE DEPARTMENT OF ASSESSMENTS AND TAXATION, THE
CORPORATE EXISTENCE OF THE AUTHORITY OR DISTRICT CEASES
AND THE AUTHORITY OR DISTRICT IS ABOLISHED AND ALL THE
PROPERTY, POWERS, RIGHTS, DUTIES AND OBLIGATIONS THEREOF
SHALL DEVOLVE UPON AND BE EXERCISED BY THE COUNTY
COMMISSIONERS.

(B)    WHERE AN AUTHORITY OR DISTRICT HAS BEEN
ABOLISHED, THE COUNTY COMMISSIONERS MAY CREATE A
DEPARTMENT OF PUBLIC WORKS, PROVIDE FOR ITS ORGANIZATION
AND FUNCTIONS AMD DELEGATE TO THE DEPARTMENT ALL OR ANY
DELEGABLE ADMINISTRATIVE DUTIES OR POWERS PROVIDED IN
SECTION 450 OF ARTICLE 43 OF THE ANNOTATED CODE OF
MARYLAND, WHEN AN AUTHORITY HAS BEEN ABOLISHED, AND
PROVIDED IN SECTION 650 OF ARTICLE 43 OF THE ANNOTATED
