2462                                         LAWS OF MARYLAND                     [Ch. 719

ORGANIZATION CERTIFIES THAT IT HAS A MEMBERSHIP
ENROLLMENT OF AT LEAST TEN PERCENT (10%) OF THE TOTAL
NUMBER OF PUBLIC SCHOOL EMPLOYEES IN A UNIT, AS OF JUNE 1
THEN AN ELECTION SHALL BE HELD, IN WHICH THE PUBLIC
SCHOOL EMPLOYEES IN THE UNIT SHALL BE OFFERED A CHOICE
AMONG EACH OF THE EMPLOYEE ORGANIZATIONS AS THE EXCLUSIVE
REPRESENTATIVE OF ALL PUBLIC SCHOOL EMPLOYEES IN THE UNIT
OR OF NO EXCLUSIVE REPRESENTATION.

(3) IF__NO OTHER EMPLOYEE ORGANIZATION

CERTIFIES THAT IT HAS A MEMBERSHIP ENROLLMENT OF AT LEAST
TEN PERCENT (10%) OF THE TOTAL NUMBER OF PUBLIC SCHOOL
EMPLOYEES IN THE UNIT, THEN, UPON REQUEST OF THE EMPLOYEE
ORGANIZATION DESCRIBED IN SUBSECTION (1) HEREOF, AN
ELECTION SHALL BE HELD WHEREIN THE BALLOT SHALL OFFER A

CHOICE BETWEEN EXCLUSIVE REPRESENTATION BY THE

ORGANIZATION AND NO EXCLUSIVE REPRESENTATION.

(4) IF NO OTHER EMPLOYEE ORGANIZATION
CERTIFIES THAT IT HAS A MEMBERSHIP ENROLLMENT OF AT LEAST
TEN PERCENT (10%) OF THE TOTAL NUMBER OF PUBLIC SCHOOL
EMPLOYEES IN THE UNIT, AND NO REQUEST FOR ELECTION IS
MADE AS PROVIDED FOR IN SUBSECTION (3) HEREOF, THEN, UPON
FURTHER CERTIFICATION BY THE EMPLOYEE ORGANIZATION

DESCRIBED IN SUBSECTION (1) HEREOF THAT IT HAS___A

MEMBERSHIP ENROLLMENT OF THE MAJORITY OF THE PUBLIC
SCHOOL EMPLOYEES IN THE UNIT IN THE COUNTY [[OR BALTIMORE
CITY]], THE PUBLIC SCHOOL EMPLOYER SHALL DESIGNATE THE
EMPLOYEE ORGANIZATION AS THE EXCLUSIVE REPRESENTATIVE OF
ALL PUBLIC SCHOOL EMPLOYEES IN THE UNIT IN THE COUNTY
[[OR BALTIMORE CITY]].

(5) THE STATE BOARD OF EDUCATION SHALL ADOPT
REASONABLE RULES AND REGULATIONS FOR VERIFYING THE NUMBER
OF PUBLIC SCHOOL EMPLOYEES WHO ARE MEMBERS IN GOOD
STANDING OF AN EMPLOYEE ORGANIZATION ON THE DATE OF
CERTIFICATION OR WHO MAY HAVE SIGNED A PETITION PROVIDED
FOR HEREIN. THE STATE BOARD OF EDUCATION SHALL ADOPT
REASONABLE RULES AND REGULATIONS FOR THE CONDUCT OF
ELECTIONS HELD HEREUNDER AND THE CERTIFICATION OF THE

RESULTS THEREOF, AND IT SHALL PROVIDE SUPERVISION OF__THE

ELECTIONS. THE ELECTIONS SHALL BE CONDUCTED IN EACH

SCHOOL FACILITY WHERE PUBLIC SCHOOL EMPLOYEES ARE

ASSIGNED ON A REGULARLY SCHEDULED SCHOOL DAY, IN A MANNER
ASSURING THE SECRECY OF THE BALLOT, AND ALL ELECTIONS
SHALL BE HELD ON A REGULAR WORKING DAY FOR PUBLIC SCHOOL
EMPLOYEES, BETWEEN JUNE 1 AND JUNE 15, INCLUSIVE. IN ALL

ELECTIONS HELD HEREUNDER, THE EMPLOYEE ORGANIZATION

RECEIVING A MAJORITY OF THE VOTES CAST IN A UNIT SHALL BE
DECLARED TO BE THE EXCLUSIVE REPRESENTATIVE OF ALL PUBLIC
SCHOOL EMPLOYEES IN THE UNIT, PROVIDED HOWEVER, THAT IF A
MAJORITY OF THE VOTES IN THE ELECTION ARE CAST FOR NO

EXCLUSIVE REPRESENTATION, THEN THERE SHALL BE NO

REPRESENTATIVE DESIGNATED FOR THE UNIT. IF (1) MORE THAN
