SECTION 3. AND BE IT FURTHER ENACTED, That new
Section 16-109.1 be and it is hereby added to Article 66
1/2 — Vehicle Laws, of the Annotated Code of Maryland
(1970 Replacement Volume and 1973 Supplement) to read as
follows:

Article 66 1/2 - Vehicle Laws
16-109.1.

A.    EVER? POLITICAL SUBDIVISION OR MUNICIPALITY
MAY ADOPT ORDINANCES, LAWS, OR REGULATIONS CONTROLLING
AND REGULATING THE PARKING OF MOTOR VEHICLES AND
PROVIDING FOR THE IMPOUNDING OF SUCH VEHICLES. IN ALL
CASES OF PARKING VIOLATIONS, THE OFFICER WHO DISCOVERS
THE VEHICLE ILLEGALLY PARKED SHALL DELIVER A CITATION TO
THE OPERATOR, OR, IF THE VEHICLE BE UNATTENDED, ATTACH A
CITATION TO THE VEHICLE IN A CONSPICUOUS PLACE. IN THE
ABSENCE OF THE OPERATOR, THE REGISTERED OWNER OF THE
VEHICLE SHALL BE PRESUMED TO BE THE PERSON RECEIVING THE
CITATION. A COPY OF THE CITATION SHALL BE RETAINED BY
THE OFFICER AND SHALL BEAR HIS CERTIFICATION, UNDER
PENALTY OF PERJURY, ATTESTING TO THE TRUTH OF THE MATTER
THEREIN SET FORTH. THE RECIPIENT OF A CITATION MAY MAKE
PAYMENT FOR THE VIOLATION DIRECTLY TO THE POLITICAL
SUBDIVISION OR MUNICIPALITY, OR IF HE DESIRES TO STAND
TRIAL FOR SAID OFFENSE MAY ELECT TO DO SO BY NOTIFYING
THE POLITICAL SUBDIVISION OR MUNICIPALITY OF HIS
INTENTION TO STAND TRIAL, AT LEAST FIVE (5) DAIS PRIOR TO
THE PAYMENT DATE SET FORTH IN THE CITATION. AT THE TIME
THE NOTICE OF INTENTION TO STAND TRIAL IS GIVEN, THE
PERSON RECEIVING THE CITATION MUST ALSO NOTIFY THE
POLITICAL SUBDIVISION OR MUNICIPALITY THAT HE DESIRES THE
PRESENCE AT SAID TRIAL OF THE OFFICER WHO ISSUED THE
CITATION. IF THE PERSON RECEIVING THE CITATION DOES NOT
NOTIFY THE POLITICAL SUBDIVISION OR MUNICIPALITY THAT HE
DESIRES THE PRESENCE OF THE OFFICER AT THE TRIAL, IT
SHALL NOT BE NECESSARY THAT THE OFFICER APPEAR AND THE
COPY OF THE CITATION BEARING THE CERTIFICATION OF THE
OFFICER SHALL BE PRIMA FACIE EVIDENCE OF THE MATTER
THEREIN SET FORTH. THE CHIEF JUDGE OF THE DISTRICT COURT
SHALL ESTABLISH PROCEDURES FOR THE TRIAL OF THE SAID
OFFENSES, INCLUDING PROCEDURES FOR NOTIFICATION OF THE
DATE, TIME AND PLACE OF TRIAL, AND SHALL PROVIDE FOR A
TRIAL DATE NOT LESS THAN FIFTEEN (15) DAYS FROM THE DATE
ON WHICH THE NOTICE OF INTENTION TO STAND TRIAL WAS
FILED.

B.     UPON NOTIFICATION BY A POLITICAL SUBDIVISION
OR MUNICIPALITY THAT THE PERSON RECEIVING A CITATION FOR
VIOLATION OF A PARKING OR IMPOUNDING ORDINANCE, LAW, OR
REGULATION HAS FAILED TO PAY THE APPROPRIATE FINE FOR THE
VIOLATION BY THE DATE OF PAYMENT SET OUT ON THE CITATION,
AND HAS FAILED TO FILE A NOTICE OF HIS INTENTION TO STAND
