Article 23B - Municipal Corporation Charter
95.
The town may condemn property of any kind, or
interest therein or franchise connected therewith, in fee
or as an easement, within the corporate limits of the
town, for any public purpose. Any activity, project, or
improvement authorized by the provisions of this charter
or any other State law applicable to the town is a public
purpose. The manner of procedure in case of any
condemnation proceeding shall be that established in
Title 12 of THE REAL PROPERTY Article [21] of [this] THE
Code.
SECTION 4. AND BE IT FURTHER ENACTED, That sections
11A, 80, 114, 138, 139, 162(b), 201, of Article 25 -
County Commissioners, of the Annotated Code of Maryland
(1973 Replacement Volume and 1973 Supplement) be and they
are hereby repealed and re-enacted, with amendments, to
read as follows:
Article 25 — County Commissioners
11A.
The county commissioners of every county in the
State may acquire by purchase, gift, devise, bequest,
condemnation, or otherwise, any property, or any interest
therein, of any kind needed for any public purpose, and
to erect buildings thereon for the benefit of the county,
and to sell at public sale any property when no longer
needed for public use, but no property may be sold until
it has been advertised for at least 20 days prior to the
date of sale provided, however, that in Frederick County,
the County Commissioners may negotiate with any
governmental body or agency located within the county for
the sale of real property no longer needed by the county
school board, without advertising the property for sale,
after three independent appraisals have been obtained.
Any proceedings for acquisition by condemnation shall be
taken pursuant to Title 12 of THE REAL PROPERTY Article
[21] of [this] THE Code.
80.
If the owner of any lands affected by the drainage
improvements refuses to accept the damages awarded him by
the board of drainage viewers and confirmed by the board
of county commissioners, and refuses the necessary access
to his lands, the board of managers may condemn a
right—of—way, and the procedure shall be as provided for
in Title 12 of THE REAL PROPERTY Article [21] of [this]
THE Code and the damages awarded as compensation shall be
