The remainder of Art. 36, §12 was repealed by
the Courts Article (Chapter 2 of the 1973 1st
Special Session of the General Assembly).

SECTION 2. AND BE IT FURTHER ENACTED, That Section
72 of Article 17 — Clerks of Courts, of the Annotated
Code of Maryland (1973 Replacement Volume and 1973
Supplement) be and it is hereby repealed and re—enacted,
with amendments, to read as follows:

Article 17 — Clerks of Courts
72.

(A)   ISSUING CERTIFICATE OF QUALIFICATION.

Each clerk of the circuit court for the counties,
and the Superior Court of Baltimore City, shall, when
required to do so by any person, give a certificate,
under the seal of his office, of the qualification of any
public officer who has taken and subscribed the oaths of
office before him, or whose oath of office is recorded in
his office.

(B)   FEE.

THE CLERK SHALL CHARGE $1 FOR ISSUING A CERTIFICATE
UNDER SEAL OF THE QUALIFICATIONS OF ANY PUBLIC OFFICIAL,
INCLUDING JUSTICES OF THE PEACE AND NOTARIES PUBLIC.

REVISOR'S NOTE: Subsection (b) is derived from Art.
36, §12(c)(1) of the Code. The only changes
are in style.

SECTION 3. AND BE      IT FURTHER ENACTED, That new

Section 74 be and it     is hereby added to Article 17 —

Clerks of Courts, of the   Annotated Code of Maryland (1973

Replacement Volume and      1973 Supplement) to read as
follows:

Article 17 — Clerks of Courts
74. CLERKS FEES FOR ADMINISTERING PUBLIC MONEY.

FOR RECEIVING, COLLECTING AND PAYING OVER ALL PUBLIC
MONEY—5% EXCEPT THE CLERK OF THE CIRCUIT COURT FOR
MONTGOMERY COUNTY, WHO SHALL RECEIVE 3% COMMISSION,
PROVIDED THAT THE CLERK OF THE CIRCUIT COURT FOR
BALTIMORE COUNTY AND ANNE ARUNDEL COUNTY SHALL BE ENTITLED
TO RECEIVE 3% AND THE CLERK OF THE SUPERIOR COURT OF
BALTIMORE CITY SHALL BE ENTITLED TO RECEIVE 2 1/2%, OF
THE AMOUNT COLLECTED FROM THE TAX APPLICABLE TO
