WHERE A COMPLAINT HAS BEEN FILED WITH THE CONSUMER
PROTECTION DIVISION OF THE ATTORNEY GENERAL'S OFFICE
ALLEGING THAT A PERSON LICENSED UNDER THIS SUBTITLE HAS
VIOLATED A PROVISION OF THE CONSUMER PROTECTION SUBTITLE
OF ARTICLE 83 OF THE ANNOTATED CODE OF MARYLAND, THE
CONSUMER PROTECTION DIVISION HAY ORDER THAT A HEARING BE
HELD TO DETERMINE IF A VIOLATION HAS OCCURRED. THE
HEARING SHALL BE HELD BEFORE A HEARING EXAMINER WHO SHALL
CONDUCT A HEARING IN ACCORDANCE WITH THE PROVISIONS OF
THE ADMINISTRATIVE PROCEDURE ACT. IF THE HEARING EXAMINER
FINDS THAT A VIOLATION HAS OCCURRED, HE SHALL HAKE A
REPORT TO THE ATTORNEY GENERAL STATING HIS FINDINGS OF
FACT AND CONCLUSIONS OF LAW AND THE ATTORNEY GENERAL MAY
APPLY TO THE APPROPRIATE COURT FOR AN ORDER OR DECREE
GRANTING SUSPENSION OR REVOCATION OF THAT LICENSE AND/OR
RESTITUTION. THE COURT SHALL CONSIDER THE HEARING
EXAMINER'S REPORT CONCLUSIVE AS TO FINDINGS OF FACT, IF
SUPPORTED BY SUBSTANTIAL EVIDENCE, BUT SHALL HAKE AN
INDEPENDENT DETERMINATION OF QUESTIONS OF LAW. FOR THE
PURPOSE OF IMPLEMENTING THIS SECTION THE ATTORNEY GENERAL
HAY APPOINT A CONSUMER PROTECTION HEARING EXAMINER, WHOSE
SALARY SHALL BE PROVIDED FOR IN THE BUDGET.]]

SECTION [[4]] 2. AID BE IT FURTHER ENACTED, That
this Act shall take effect July 1, 1974.
