1684                                          LAWS OF MARYLAND                        [Ch. 438

PANEL OR BY THE CAB OF THE VEHICLE, AND ON THE REAR BY A
TAILGATE, BOARD, OR PANEL, ALL OF WHICH MUST BE SO
CONSTRUCTED AS TO PREVENT THE ESCAPE OF ANY PART OF THE
LOAD BECAUSE OF BLOWING , FALLING, OR SPILLING. NO PART
OF THE LOAD MAKING CONTACT WITH ANY SIDEBOARD OR
SIDEPANEL OR REAR PART OF THE ENCLOSURE SHALL BE WITHIN 6
INCHES OF THE TOP OF THE PART OF THE ENCLOSURE CONTACTED,
UNLESS THE LOAD IS COVERED WITH A FIRMLY SECURED CANVAS
OR SIMILAR TYPE COVERING. THE PROVISIONS OF THIS
PARAGRAPH DO NOT APPLY TO ANY LOAD-CARRYING COMPARTMENT
THAT COMPLETELY ENCLOSES THE LOAD OR TO THE TRANSPORTING
OF AMY LOAD THAT IS SUITABLY COVERED OR SECURED BY OTHER
MEANS WHICH PREVENT THE ESCAPE OF LOOSE MATERIAL.

(2) THE EXCESS SPILLAGE OF LOOSE MATERIAL ON THE
NON-LOAD CARRYING PARTS OF THE VEHICLE OCCASIONED BY OR
FROM THE ACT OF LOADING SHALL BE REMOVED BEFORE THE
VEHICLE IS OPERATED OVER A PUBLIC ROAD, STREET, OR
HIGHWAY OF THIS STATE. THE TAILGATE SHALL BE SECURELY
CLOSED TO PREVENT SPILLAGE DURING TRANSPORTATION, WHETHER
LOADED OR EMPTY. THE BED SHALL NOT HAVE ANY HOLES,
CRACKS, OR OPENINGS THROUGH WHICH LOOSE MATERIAL MAY
ESCAPE. THE RESIDUE OF TRANSPORTED LOOSE MATERIAL SHALL
BE REMOVED FROM THE NON-LOAD CARRYING PARTS OF THE
VEHICLE UPON COMPLETION OF UNLOADING BEFORE THE VEHICLE
IS AGAIN OPERATED. THE PROVISIONS OF THIS PARAGRAPH DO
NOT APPLY TO ANY CONSTRUCTION VEHICLE OR MINING EQUIPMENT
MOVING BETWEEN CONSTRUCTION BARRICADES ON A PUBLIC WORKS
PROJECT, OR MERELY CROSSING A PUBLIC ROAD, STREET OR
HIGHWAY.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.

AN ACT concerning

Vehicle Laws — Drivers' License Suspension

FOR the purpose of removing the provision that licenses
of drivers with outstanding warrants not be renewed
and establishing new procedures to provide for
suspension of [[drivers]] drivers' licenses for
failing to appear at an administrative hearing or
District Court trial.
