VACANT AND ANY MEMBER OF SAID BOARD SHALL SERVE UNTIL HIS
SUCCESSOR TAKES OFFICE.

(4) THE BOARD IS AUTHORIZED TO APPOINT A
SECRETARY OF THE BOARD AND SUCH OTHER ASSISTANTS AND
EMPLOYEES AS MAY BE NECESSARY FOR THE PROPER PERFORMANCE
OF THE DUTIES AND BUSINESS OF THE BOARD AND ALL OF THE
APPOINTMENTS SHALL BE MADE PURSUANT TO THE LAWS, RULES
AND REGULATIONS PERTAINING TO OR ISSUED BY THE SECRETARY
OF TRANSPORTATION.

(F)    THE BOARD OF AIRPORT ZONING APPEALS IS
AUTHORIZED AND EMPOWERED TO HEAR, DECIDE AND GRANT
SPECIFIC VARIANCES FROM AIRPORT ZONING REGULATIONS IN
CASES OF PRACTICAL DIFFICULTY OR UNNECESSARY HARDSHIP
AFTER PUBLIC NOTICE HAS BEEN GIVEN AND A HEARING HELD IN
CONNECTION THEREWITH. ANY PERSON DESIRING TO ERECT ANY
STRUCTURE OR INCREASE THE HEIGHT OF ANY STRUCTURE, OR
PERMIT THE GROWTH OF ANY TREE, OR OTHERWISE USE HIS
PROPERTY, IN VIOLATION OF ANY AIRPORT ZONING REGULATION,
MAY MAKE APPLICATION FOR A VARIANCE FROM THE AIRPORT
ZONING REGULATIONS IN QUESTION. IN ALL APPLICATIONS FOR
VARIANCE PERMITS THE BOARD SHALL ACT AS A FACT-FINDING
BODY AND AS A GUIDE TO ITS DECISION SHALL GIVE
CONSIDERATION, AMONG OTHER THINGS, TO THE RULES,
REGULATIONS, RESTRICTIONS, GUIDES AND STANDARDS SET FORTH
IN THIS SECTION AND IN THE AIRPORT ZONING RULES AND
REGULATIONS ADOPTED BY THE ADMINISTRATION, IF ANY, AND
ESPECIALLY TO THE FOLLOWING:

(1)    THE GUIDES AND STANDARDS SET FORTH IN
SUBSECTION (B) OF THIS SECTION;

(2)   THE HEIGHT AND WIDTH OR PROPOSED HEIGHT
AND WIDTH AND USE OR PROPOSED USE OF THE PARTICULAR
STRUCTURE OR TREE IN CONNECTION WITH WHICH A VARIANCE
FROM THE AIRPORT ZONING REGULATIONS IS BEING REQUESTED;

(3)    WHETHER OR NOT THE PARTICULAR STRUCTURE
OR TREE WILL CREATE OR BECOME AN AIRPORT HAZARD; AND

(4)    WHETHER OR NOT THE ISSUANCE OF SUCH
PERMIT WILL RESULT IN ENDANGERING THE PUBLIC HEALTH,
SAFETY, SECURITY OR ORDER.

(G)    APPEALS MAY BE TAKEN FROM ANY DECISION OF THE
BOARD OF AIRPORT ZONING APPEALS TO THE CIRCUIT COURT FOR
[[ANNE ARUNDEL COUNTY LOCATED IN ANNAPOLIS, MARYLAND,]]
THE COUNTY IN WHICH THE STATE OWNED AIRPORT IS LOCATED IN
THE MANNER INDICATED IN SECTION 8-801 OF THIS ARTICLE.

(H) THE AIRPORT ZONING REGULATIONS ADOPTED
PURSUANT TO THE POWER AND AUTHORITY CONTAINED IN THIS
SECTION AND ALL THE PROVISIONS OF SECTION 8-801 AND THIS
