AN ACT concerning
Anne Arundel, Charles, St. Mary's, and Calvert —
Games and Contests
FOR the purpose of authorizing nonfranchise retail
merchants in Anne Arundel, Charles, St. Mary's, and
Calvert counties to give away prizes by drawings if
no purchase or [[contest]] consideration is required
to qualify for the prizes, and re-arranging certain
counties in an alphabetical order.
BY repealing and re-enacting, with amendments,
Article 27 — Crimes and Punishments
Section 369A(b)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 369A(b) of Article 27 - Crimes and
Punishments, of the Annotated Code of Maryland (1971
Replacement Volume and 1973 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:
Article 27 — Crimes and Punishments
369A.
(b) No retail establishment regulated or licensed
pursuant to the provisions contained in Article 56 of the
Annotated Code of Maryland, as amended, shall use any
game, contests, lottery or other scheme or device,
whereby a person or persons may receive gifts, prizes or
gratuities as determined by chance for the purpose of
promoting, furthering or advertising the sale of any
product or service of whatsoever nature or kind, and the
fact that no purchase is required in order to participate
in the game, contest, lottery or scheme shall not exclude
such game, contest, lottery or scheme from the provisions
of this section. Nothing in this section shall be
construed as preventing any nonfranchise retail merchant
in [Dorchester, Worcester, Wicomico, Frederick and
