SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 4A-4(b), 9-3 and 9-4 of Article
33 - Election Code, of the Annotated Code of Maryland
(1971 Replacement Volume and 1973 Supplement) be and they
are hereby repealed and re—enacted, with amendments, to
read as follows:
Article 33 — Election Code
4A-4.
(b) In a State legislative district comprising more
than one county, or in a State [legislative subdistrict]
DELEGATE DISTRICT comprising more than one county, any
vacancy occurring because there is no candidate of a
political party to file for the office shall be filled by
vote of the State central committee in each of those
counties in the district [or subdistrict]. The State
central committee of each county involved shall [have one
vote for the choice to fill the vacancy in nomination]
CAST A VOTE PROPORTIONATE TO ITS SHARE OF THE POPULATION
OF THE DISTRICT WHERE THE VACANCY EXISTS. SUCH
POPULATION SHALL BE BASED ON THE MOST RECENT DECENNIAL
UNITED STATES CENSUS. If one person fails to receive a
majority of the votes or if there is a tie vote between
or among the state central committees, the vacancy shall
be filled by the State central committee for the State of
the party.
9-3.
In a State legislative district comprising more than
one county, or in a State [legislative subdistrict]
DELEGATE DISTRICT comprising more than one county, any
vacancy occurring because of the death or resignation of
any person nominated for State Senator or member of the
House of Delegates in such legislative district or
[subdistrict] DELEGATE DISTRICT shall be filled by vote
of the State central committees of the party in each of
those counties in the district [or subdistrict]. The
State central committee of each county involved shall
[have one vote for the choice to fill the vacancy in
nomination] CAST A VOTE PROPORTIONATE TO ITS SHARE OF THE
POPULATION OF THE DISTRICT WHERE THE VACANCY EXISTS. SUCH
POPULATION SHALL BE BASED ON THE__MOST __RECENT DECENNIAL
UNITED STATES CENSUS. If one person fails to receive a
majority of the votes or if there is a tie vote between
or among the State central committees, the vacancy shall
be filled by the State central committee for the State of
