SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 2-315 of Article 95B - Uniform
Commercial Code, of the Annotated Code of Maryland (1964
Replacement Volume and 1973 Supplement) be and it is
hereby repealed and re—enacted, with amendments, to read
as follows:

Article 95B — Uniform Commercial Code
2-315.

(1)    Where the seller at the time of contracting
has reason to know any particular purpose for which the
goods are required and that the buyer is relying on the
seller's skill or judgment to select or furnish suitable
goods, there is unless excluded or modified under the
next section an implied warranty that the goods shall be
fit for such purpose.

(2)    THE PROVISIONS OF SUBSECTION (1) APPLY TO A
LEASE OF GOODS AND A BAILMENT FOR HIRE OF GOODS THAT PASS
THROUGH THE PHYSICAL POSSESSION AND ABE MAINTAINED BY THE
LESSOR. SUBLESSOR, OR BAILOR. [[THAT PASS THROUGH THE
PHYSICAL POSSESSION AND ARE MAINTAINED BY THE LESSOR,
SUBLESSOR, OR BAILOR.]] [[;PROVIDED THAT THE LESSOR OR
BAILOR IS A MERCHANT WITH RESPECT TO GOODS OF THAT KIND]]

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1974.
