assistance, and the Commission shall furnish the
Secretary with such information as the Secretary may
require to make said determinations. On or before August
1, 1972, and on or before August 1 of each year
thereafter, the Commission shall furnish to the Secretary
its proposed budget for the following fiscal year.
Thereafter, the Commission shall promptly notify the
Secretary of and obtain his approval for any changes in
the proposed budget for regional projects funded under
this section. Notwithstanding any of the provisions of
Chapter 780 of the Laws of Maryland, (1959), as amended,
the Secretary may require an annual audit of the
Commission's operations relating to any projects financed
in whole or in part by payments to the Commission from
the Department [of State Planning].
SECTION 3. AND BE IT FURTHER ENACTED, That new
Sections 14 through 27 be and they are hereby added to
Article 88C — State Planning, of the Annotated Code of
Maryland (1969 Replacement Volume and 1973 Supplement) to
read as follows:
Article 88C - State Planning
14. STATE LAND USE BOARD.
THE STATE LAND USE BOARD IS CREATED AS AN
INDEPENDENT UNIT WITHIN THE DEPARTMENT. THE BOARD IS
PART OF THE DEPARTMENT ONLY FOR THE PURPOSES OF BUDGET,
OFFICE SPACE, AND SUPPLIES. THE PROVISIONS OF SECTIONS
3A, 3B, AND 226 AND 228 OF ARTICLE 41 OF THE MARYLAND
CODE AS THEY PERTAIN TO THE BOARD DO NOT APPLY.
15. MEMBERSHIP, TENURE, CHAIRMAN, COMPENSATION.
[[(A) THE BOARD CONSISTS OF NINE MEMBERS APPOINTED
BY THE GOVERNOR WITH THE ADVICE AND CONSENT OF THE
SENATE. OF THE NINE MEMBERS APPOINTED, THERE SHALL BE AT
LEAST ONE MEMBER ACTIVELY ENGAGED IN AGRICULTURE. THERE
SHALL BE ONE MEMBER FROM EACH OF THE FOLLOWING REGIONS OF
THE STATE: (1) BALTIMORE CITY; (2) BALTIMORE COUNTY; (3)
ANNE ARUNDEL COUNTY; (4) PRINCE GEORGE'S COUNTY; (5)
MONTGOMERY COUNTY; (6) ALLEGANY, FREDERICK, GARRETT AND
WASHINGTON COUNTIES; (7) CALVERT, ST. MARY'S AND CHARLES
COUNTIES; (8) CAROLINE, CECIL, KENT, QUEEN ANNE'S,
TALBOT, DORCHESTER, SOMERSET, WICOMICO AND WORCESTER
COUNTIES; AND (9) HARFORD, CARROLL AND HOWARD COUNTIES.
THE GOVERNOR, IN MAKING THE APPOINTMENTS, SHALL TAKE INTO
CONSIDERATION THE REPRESENTATION OF THE VARIOUS LOCAL
GOVERNMENTS AND COMMUNITIES, AND BUSINESS, ECONOMIC,
ENVIRONMENTAL AND CONSERVATION INTERESTS IN THE STATE. ]]
