budgetary transfers of funds
appropriated herein by budget
amendment or otherwise, from
these programs to any other
programs or purposes. Any
budgetary transfers from
program .03 Medical
Assistance Program to any
other program of the Medical
Care Programs Administration
must receive prior approval
of the General Assembly in
accordance with Article 41,
Section 245(c) of the Laws
of Maryland.

"Payments hereunder are autho-
rized as budgeted" not to
exceed $20.70 per day, per
patient, for Nursing Home
Care provided those homes
qualify as skilled nursing
homes under the regulations
promulgated by the U.S. De-
partment of Health, Education
and Welfare under Title XIX
of the United States Social
Security Act. The $20.70
maximum may only be exceeded
with the prior approval of the
General Assembly in accordance
with Article 41, Section 245(c)
of the Laws of Maryland, or in
accordance with Article 43,

Section 42D, if allowable by

the U.S. Department of Health,
Education and Welfare for
federal reimbursement.

The schedule of payments estab-
lished by the State for pay-
ment to such nursing home
shall not exceed, including
cost and profit factors,
those established by the
Secretary of Health, Educa-
tion and Welfare in the
Administration of Title XIX
of the Social Security Act
as amended if such schedule
jeopardizes continued
eligibility for federal
