884                                        LAWS OF MARYLAND                            [Ch. 4

BACKFILLING AND GRADING, RESTORATION OF PLANT COVER,
PREVENTION OF EROSION, PREVENTION OF THE CREATION OF
ACID WATER, AND ANY OTHER ACTION WHICH IS CONDUCIVE TO
THE CONSERVATION AND BEST UTILIZATION OF THE NATURAL
RESOURCES OF MARYLAND. THE COMMITTEE SHALL REVIEW ALL
MINING AND RECLAMATION PLANS, PROGRESS REPORTS, AND
FINAL REPORTS. IT ALSO SHALL SET THE AMOUNT OF ANY
REVEGETATION BOND. THE COMMITTEE MAY INSPECT OR HAVE
INSPECTED ANY OPEN-PIT MINING OPERATION AT ANY TIME IN
ORDER TO DETERMINE LAND RECLAMATION, CONSERVATION, AND
REVEGETATION CONDITIONS. IT SHALL ESTABLISH PLANS AND
METHODS OF PROCEDURE AS WELL AS PRACTICAL GUIDELINES
FOR PROMPT AND ADEQUATE RECLAMATION, CONSERVATION,
AND REVEGETATION OF ALL LANDS DISTURBED BY OPEN-PIT
MINING OF BITUMINOUS COAL WITHIN THE STATE. THESE
PLANS, METHODS OF PROCEDURE, AND PRACTICAL GUIDELINES
SHALL BE SUBMITTED TO THE BUREAU. FINALLY, THE
COMMITTEE SHALL REVIEW THE STRIP MINING LAWS OF THE
STATE TO ASSURE COMPLIANCE WITH THE SPIRIT OF THE
SUBTITLE DEALING WITH STRIP MINING.

REVISOR'S NOTE: This subsection presently appears
as Article 66C, section 660(b) of the Code.
The committee advises that the "proper
regulatory agency" described in this
subsection is the bureau. The only other
changes made are in style.

7-206. EXAMINING BOARD.

(A) APPOINTMENT; QUALIFICATIONS; OATHS; SALARY
AND EXPENSES.—UPON THE RECOMMENDATION OF THE DIRECTOR
OF THE BUREAU, CONCURRED IN BY THE SECRETARY, THE
GOVERNOR SHALL APPOINT TWO PERSONS, ONE A MINER AND
THE OTHER AN OPERATOR, WHO WITH THE DIRECTOR SHALL
CONSTITUTE AN EXAMINING BOARD. THE DIRECTOR SHALL BE
CHAIRMAN, EX OFFICIO. EACH APPOINTED MINER AND
OPERATOR SHALL: (1) BE A CITIZEN OF THE UNITED STATES
AND A RESIDENT OF THE STATE; (2) BE NOT LESS THAN 30
YEARS OF AGE; (3) HAVE AT LEAST FIVE YEARS' PRACTICAL
EXPERIENCE IN THE COAL MINING INDUSTRY IMMEDIATELY
PRECEDING THE APPOINTMENT; AND (4) BE A PERSON OF
INTEGRITY, KNOWN INTELLIGENCE, AND WHO HAS KNOWLEDGE
OF THIS OCCUPATION. A MEMBER SHALL REMAIN IN OFFICE
UNTIL HIS SUCCESSOR IS APPOINTED AND QUALIFIED.
BEFORE ENTERING UPON THE DUTIES OF THE OFFICE, EACH
MEMBER SHALL TAKE AND SUBSCRIBE THE OATH PROVIDED BY
THE CONSTITUTION. THE BOARD SHALL HAVE THE OFFICE
ROOM, MEETING SPACE, EQUIPMENT, STENOGRAPHIC AND OTHER
ASSISTANCE, SUPPLIES, AND FACILITIES THE SECRETARY
APPROVES. EMPLOYEES OF THE BOARD SHALL BE SELECTED IN
