7-205. LAND RECLAMATION [[ADVISORY]] COMMITTEE.
(A) CREATED AND CONTINUED; COMPOSITION;
CHAIRMAN; REIMBURSEMENT FOE EXPENSES; MEETINGS;
QUORUM; MAJORITY VOTE REQUIRED.—THE LAND RECLAMATION
COMMITTEE IS CREATED AND CONTINUED. IT IS COMPOSED OF
NINE MEMBERS AS FOLLOWS:
THE DIRECTOR OF THE SURVEY, WHO ACTS AS
CHAIRMAN; THE CHAIRMAN OF THE SOIL CONSERVATION
DISTRICT SUPERVISORS OF ALLEGANY COUNTY, AND THE
CHAIRMAN OF THE SOIL CONSERVATION DISTRICT SUPERVISORS
OF GARRETT COUNTY OR THEIR DESIGNATED REPRESENTATIVES;
TWO MEMBERS OR THEIR DELEGATED ALTERNATES APPOINTED BY
THE GOVERNOR WITH THE ADVICE AND CONSENT OF THE SENATE
FOR THREE-YEAR TERMS TO REPRESENT THE MINING INDUSTRY;
AND THE DIRECTOR [[OR HIS REPRESENTATIVE]] OF THE
BUREAU, AND THREE ADDITIONAL MEMBERS FROM THE
DEPARTMENT__APPOINTED BY THE SECRETARY. COMMITTEE
MEMBERS SERVE WITHOUT COMPENSATION AND SHALL BE
REIMBURSED FOR TRAVEL AND ACTUAL EXPENSES INCURRED IN
THE PERFORMANCE OF THEIR DUTIES. FUNDS FOR EXPENSES
SHALL BE PROVIDED FOR IN THE BUDGET OF THE SURVEY.
THE COMMITTEE SHALL MEET AT THE CHAIRMAN'S REQUEST;
AND AT LEAST TWICE A YEAR. A QUORUM CONSISTS OF AT
LEAST FIVE MEMBERS. A MAJORITY VOTE OF THE FULL
COMMITTEE IS NECESSARY TO APPROVE ANY ACTION.
REVISOR'S NOTE: This subsection presently appears
as Article 66C, section 660 (a) of the
Code. Nomenclatural changes are made
pursuant to Chapter 348, Acts of 1972.
While the Survey is a part of the
department, it has a separate allotment in
the State budget and, therefore, no change
in the provision of this subsection has
teen made relating to funds for expenses.
The only other changes made are in style.
(E) POWERS AND DUTIES.--THE COMMITTEE SHALL
STUDY, RECOMMEND, AND APPROVE ALL PROCEDURES FOR
RECLAMATION, CONSERVATION, AND REVEGETATION OF ANY
AREA AFFECTED BY OPEN-PIT MINING WITHIN THE STATE.
