878                                       LAWS OF MARYLAND                             [Ch. 4

SECRETARY OF PERSONNEL, A PERSON KNOWN AS THE
"DIRECTOR OF THE BUREAU OF MINES", TO BE IN CHARGE OF

THE BUREAU. THE DIRECTOR SHALL CONTINUE TO HOLD

OFFICE IN ACCORDANCE WITH THE PROVISIONS OF THE MERIT

SYSTEM LAW. IF A VACANCY IN THE OFFICE OCCURS, A

SUCCESSOR SHALL BE SELECTED AND APPOINTED IN THE SAME
MANNER.

REVISOR'S NOTE: This subsection presently appears
as Article 66C, section 488 of the Code.
The "State Commissioner of Personnel" is
proposed for deletion and "Secretary of the
Department of Personnel" is substituted
therefor in light of Chapter 98, Acts of
1970, which established the Department of
Personnel to be beaded by a secretary.
Furthermore, all references to the "Chief
Mine Engineer" are proposed for deletion as
obsolete. By legislative amendment,
language is added to make clear that the
position of director of the Bureau of Mines
is within the merit system. The language
"by reason of death, resignation or
otherwise", is proposed for deletion
because the new language covers any vacancy
for whatever reason. The only other
changes made are in style.

(B) QUALIFICATIONS, AND REQUIREMENTS OF
OFFICE.—THE DIRECTOR SHALL BE A CITIZEN OF MARYLAND.
HE SHALL HAVE AT LEAST TEN YEARS' PRACTICAL EXPERIENCE
IN THE WORKING, VENTILATION, AND DRAINAGE OF
BITUMINOUS COAL MINES, AND A PRACTICAL AND SCIENTIFIC
KNOWLEDGE OF ALL NOXIOUS AND DANGEROUS GASES FOUND IN
ANY MINE. GRADUATION WITH A DEGREE IN MINING
ENGINEERING FROM A SCHOOL OF RECOGNIZED STANDING SHALL
BE CONSIDERED EQUIVALENT TO TWO YEARS' WORKING
EXPERIENCE. THE DIRECTOR SHALL DEVOTE FULL TIME TO
THE DUTIES OF THE OFFICE, AND MAY NOT DIRECTLY OR
INDIRECTLY HAVE A FINANCIAL INTEREST IN ANY WAY IN ANY
COAL MINE, MINING OPERATION, OR MINING INVESTMENT IN
THIS OR ANY CONTIGUOUS STATE.

amended by Chapter 679, S.B. 390, Acts of
1973.
