76                                            LAWS OF MARYLAND                                [Ch. 2

MAY APPOINT A STENOGRAPHER TO TAKE AND TRANSCRIBE THE
TESTIMONY GIVEN BEFORE THE GRAND JURY FOR THE
EXCLUSIVE USE AND BENEFIT OF THE GRAND JURY AND THE
STATE'S ATTORNEY OF THE COUNTY UNLESS OTHERWISE
ORDERED BY THE COURT.

(B)   OATH AND PENALTY.

(1)   ANY STENOGRAPHER APPOINTED TO RECORD
TESTIMONY BEFORE A GRAND JURY SHALL TAKE AND SUBSCRIBE
AN OATH THAT HE WILL KEEP SECRET ALL MATTERS AND
THINGS OCCURRING BEFORE THE GRAND JURY.

(2)   A STENOGRAPHER WHO VIOLATES THE OATH
OF SECRECY IS GUILTY OF A MISDEMEANOR AND IS SUBJECT
TO A FINE OF $1,000 OR IMPRISONMENT FOR NOT MORE THAN
ONE YEAR, OR BOTH.

(C)   ATTENDANCE AT SESSIONS.

A STENOGRAPHER APPOINTED UNDER THIS SECTION MAY
BE PRESENT AT THE SESSIONS OF THE GRAND JURY.

(D)   COMPENSATION.

THE STENOGRAPHER SHALL RECEIVE THE COMPENSATION
SET BY THE JUDGES OF THE COURT. IF THE STENOGRAPHER
SERVES IN MORE THAN ONE COUNTY, HIS SALARY SHALL BE
SHARED BY THE COUNTIES IN WHICH HE SERVES IN
PROPORTION AS AGREED BY THE ADMINISTRATIVE JUDGES OF
THE COUNTIES.

REVISOR'S NOTE: This section is new language
derived from Art. 26, §§ 39 - 42 which are
proposed for repeal. Subsection (a) is
derived from §§ 39 and 39A. Subsection
(b) (1) is derived from §40. Subsection
(b) (2) is derived from §42. Subsection (c)
is derived from §41. Subsection (d) is the
salary provision of §39. These sections
originally applied to only Calvert,
Charles, St. Mary's, and Talbot Counties,
however, it is broadened to authorize grand
jury stenographers in all counties, since
most counties have such stenographers.
