SHALL RECORD, INDEX, AND MAINTAIN THE FOLLOWING
INFORMATION WHEN FILED IN THE COURT:
(1) AN AUDITOR'S REPORT OF DISTRIBUTION OF
PROCEEDS OF A SALE OF REAL OR PERSONAL PROPERTY IF
RATIFIED BY THE COURT OF WHICH HE IS CLERK;
(2) ALL BONDS OF EVERY NATURE AND KIND
GIVEN IN ANY PROCEEDING IN THE COURT; AND
(3) A TEST BOOK CONTAINING THE OATHS OF
OFFICE AND SIGNATURES OF EVERY PERSON WHO TAKES THE
OATH BEFORE THE CLERK.
REVISOR'S NOTE: Paragraph (1) is new language
derived from Art. 17, §7. The provision
exempting Somerset and Baltimore Counties
from the section is proposed for deletion.
The clerks of these counties assured us
that they record auditor's reports when
filed, and a portion of this section will
appear in the costs title of this article.
The exception for Calvert County also is
proposed for deletion on recommendation of
the Commission, although the clerk of that
county has not acquiesced in this decision.
Paragraph (2) is new language derived from
Art. 17, §53. The provision making a
certified copy of the record admissible as
evidence is proposed for deletion. Sec.
10—204 of this article makes such records
admissible.
Paragraph (3) is new language derived from
Art. 70, §8.
This section contains only those recording
provisions not properly allocable
elsewhere. Other recording provisions will
be found with the substantive law to which
they pertain, i.e., divorce decrees -
Family Laws, deeds and mortgages —
Property, financing statements and security
agreements — Commercial Law.
