(A) ASSIGNMENT AND TRANSFER FEE. - A RECORDING
FEE OF $5 SHALL ACCOMPANY EVERY APPLICATION FOR
ASSIGNMENT OR TRANSFER OF ANY INTEREST ACQUIRED UNDER
THIS SUBTITLE.

(B) ASSIGNMENT OR TRANSFER TO NON-RESIDENT
PROHIBITED. - A PERSON MAY NOT ASSIGN OR TRANSFER ANY
INTEREST ACQUIRED BY THIS SUBTITLE TO A NON-RESIDENT
OF THE STATE. AN ASSIGNMENT TO A NON-RESIDENT IS NOT
VALID FOR ANY PURPOSE AND, IF ATTEMPTED, ANY INTEREST
OF THE GRANTOR OR ASSIGNOR REVERTS TO THE STATE AS IF
A LEASE HAD NOT BEEN MADE.

(C) OTHER PROHIBITED ASSIGNMENTS. - IF A PERSON
ATTEMPTS TO ASSIGN ANY INTEREST CREATED BY THIS
SUBTITLE TO ANY CORPORATION OR JOINT-STOCK COMPANY,
THE INTEREST OF THE GRANTOR OR ASSIGNOR SHALL REVERT
TO THE STATE AS IF A LEASE HAD NOT BEEN MADE. IF A
PERSON ATTEMPTS TO ASSIGN ANY INTEREST CREATED BY THIS
SUBTITLE TO ANY PERSON SO THAT THE ASSIGNEE HOLDS
ACREAGE EXCEEDING THE MAXIMUM LIMITS PERMITTED BY
§4-1108 OF THIS ARTICLE, THE INTEREST OF THE GRANTOR
OR ASSIGNOR SHALL REVERT TO THE STATE AS IF A LEASE
HAD NOT BEEN MADE.

REVISOR'S NOTE: This section presently appears as
Article 66C, section 708(r) of the Code and
has been divided into sections for purposes
of organization. Subsection (a) is new
language derived from the third sentence of
section 708(r). In subsection (c) the
reference to specific acreage is proposed
for deletion and a single reference to
proposed section 4—1108(d), which sets
forth the maximum acreage leasable is
substituted therefor. The only other
changes made are in style.

4-1113. MARKING OF LEASED LAND.

IMMEDIATELY UPON ENTERING INTO A LEASE, EVERY
LESSEE, SHALL DESIGNATE LEASED OYSTER BOTTOMS BY
PLAINLY MARKING THEM WITH STAKES, BUOYS, OR MONUMENTS,
UNDER THE SUPERVISION OF THE DEPARTMENT. THE INITIALS
OF THE LESSEE SHALL BE MARKED ON AT LEAST POOR STAKES,
BUOYS, OR MONUMENTS. REQUESTS FOR RESURVEYS FOR THE
PURPOSE OF RELOCATING OR REPLACING STAKES, BUOYS, OR
MONUMENTS SHALL BE ACCOMPANIED BY A $5 FEE FOR EACH
STAKE, BUOY, OR MONUMENT. HOWEVER, THE TOTAL FEE FOR
ANY RESURVEY MAY NOT EXCEED $20. THE LESSEE SHALL
EXERCISE REASONABLE DILIGENCE IN MAINTAINING BUOYS,
