A LEASE REMAINS UNPAID FOR MORE THAN 60 DAYS AFTER IT
BECOMES DUE, THE DEPARTMENT MAY DECLARE THE LEASE NULL
AND VOID AND THE LAND SHALL REVERT TO THE STATE AND
MAY BE LEASED AGAIN. THE DEPARTMENT MAY CANCEL ANY
LEASE, EITHER IN WHOLE OR IN PART, AND MAY DIMINISH OR
CANCEL THE ANNUAL RENTAL TO AN EXTENT COMMENSURATE
WITH THE AREA REMAINING UNDER LEASE ON THE WRITTEN
REQUEST OF THE LESSEE. IF A LESSEE OF SUBMERGED LANDS
IN CHARLES COUNTY DOES NOT SEED WITH OYSTERS WITHIN A
PERIOD OF THREE YEARS, THE LEASE SHALL TERMINATE.
REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 708 (n) of the Code.
The provision establishing minimum rent is
proposed for deletion since the amount set
is so unrealistically low that it is highly
unlikely that the department would
contemplate such a rent. The provision
relating to leases in force in 1945 is also
proposed for deletion because it is now
obsolete.
Subsection (b) presently appears as Article
66C, section 708(bb) of the Code.
Subsection (c) presently appears as Article
66C, section 708(o) of the Code. The only
other changes made are in style.
4—11ll. DISPOSITION OF OYSTER CULTURE FEES.
EVERY FEE, FUND, AND REVENUE DERIVED FROM THE
ADMINISTRATION OF THE PROVISIONS OF THIS SUBTITLE
RELATING TO PRIVATE OYSTER CULTURE SHALL BE PAID TO
THE COMPTROLLER OF THE TREASURY TO BE CREDITED TO THE
FISHERIES RESEARCH AND DEVELOPMENT FUND.
REVISOR'S NOTE: This section presently appears as
Article 66C, section 708(z) of the Code.
The present reference to "section" is
proposed for deletion and a reference to
"subtitle" substituted therefor. The
provisions of present section 708 are set
forth in several sections within this
subtitle. The present reference to the
Oyster Fund is also proposed for deletion
and its proper name is substituted
therefor. The only other changes made are
in style.
