THE STATE ASSENTS TO THE PROVISIONS OF THE ACT OF
CONGRESS ENTITLED "AN ACT TO PROVIDE THAT THE UNITED
STATES SHALL AID THE STATES IN PISH RESTORATION AND
MANAGEMENT PROJECTS, AND FOR OTHER PURPOSES", APPROVED
AUGUST 9, 1950, PUBLIC LAW 681, EIGHTY-FIRST CONGRESS,
64 STAT. 658. THE DEPARTMENT SHALL PERFORM EVERY ACT
NECESSARY TO CONDUCT AND ESTABLISH COOPERATIVE FISH
RESTORATION PROJECTS, AS DEFINED IN THIS ACT OF
CONGRESS, IN COMPLIANCE WITH ACT AND RULES AND
REGULATIONS THE SECRETARY OF THE INTERIOR PROMULGATES
PURSUANT TO IT.

REVISOR'S NOTE: This section presently appears as
Article 66C, section 227 of the Code. It
is placed in this subtitle because the Act
of Congress concerns all species of fish in
both tidal and nontidal waters. The last
clause is proposed for deletion and placed
in section 4-208.

The only other changes made are in style.

4-208. STATE FISHERIES MANAGEMENT AND [[PROTECTIVE]]
PROTECTION FUND CREATION.

(A)    CREATION.—THE STATE FISHERIES MANAGEMENT
AND PROTECTION FUND IS CREATED AND CONTINUED WITHIN
THE DEPARTMENT. ANY MONEY [[ACCRUING TO THE FUND FROM
SPORT FISHING LICENSE AND STAMP FEES]] RECEIVED FROM

ANY FISH AND FISHERIES LICENSE, STAMP, PERMIT, OR

APPLICATION FEE AS PROVIDED IN THIS TITLE, UNLESS

OTHERWISE PROVIDED SHALL BE CREDITED TO THIS FUND AND
USED ONLY FOR THE SCIENTIFIC INVESTIGATION,
PROTECTION, PROPAGATION, AND MANAGEMENT OF NON-TIDAL
FINFISH.

(B)    COLLECTION AND TRANSMISSION OF FUNDS.—THE
CLERKS OF THE COURTS SHALL TRANSMIT TO THE DEPARTMENT
ON THE FIRST DAY OF EACH MONTH ANY MONEY RECEIVED BY
THEM FOR SPORT FISHING LICENSES AND STAMPS. THE
DEPARTMENT SHALL ACCOUNT FOR THESE FUNDS TO THE
TREASURER WHO THEN SHALL CREDIT AMOUNTS RECEIVED TO
THE STATE FISHERIES MANAGEMENT AND PROTECTION FUND.
THE TREASURER SHALL PAY OUT FUNDS ON THE WARRANT OF
THE COMPTROLLER UPON REQUISITION OF THE DEPARTMENT.
