4-209. FISHERIES RESEARCH AND DEVELOPMENT FUND
CREATED AND CONTINUED.

THE FISHERIES RESEARCH AND DEVELOPMENT FUND IS
CREATED AND CONTINUED WITHIN THE DEPARTMENT. ANY
MONEY THE STATE COMPTROLLER RECEIVES UNDER THE
PROVISIONS OF THIS TITLE FROM COMMERCIAL LICENSE FEES,
TAXES, AND ROYALTIES PAID TO THE STATE FOR OYSTER
SHELLS AND CLAM SHELLS REMOVED FROM THE BOTTOM BENEATH
THE TIDAL WATERS OF THE STATE, OR ANY SOURCE, TOGETHER
WITH ANY FINE OR FORFEITURE COLLECTED PURSUANT TO
§4-1202[[ (A) ]] OF THIS TITLE, SHALL BE CREDITED TO THE
FISHERIES RESEARCH AND DEVELOPMENT FUND. THE FUND
SHALL BE USED FOR REPLENISHING FISHERIES RESOURCES,
[[MARKETING FISHERIES PRODUCTS AND]] RELATED RESEARCH,
AND TO MATCH FEDERAL FUNDS AVAILABLE FOR RESEARCH AND
DEVELOPMENT OF FISHERIES RESOURCES.

REVISOR'S NOTE; This section is new language
derived from Article 66c, section 716 of
the Code, as amended by Chapter 331, H.B.
974, Acts of 1973. It is convenient to set
forth the creation of this fund initially
in this title.

4-210. AUTHORITY TO PROTECT ENDANGERED SPECIES OF
FISH.

(A) LEGISLATIVE FINDINGS. - THE GENERAL ASSEMBLY
FINDS THAT CERTAIN FISH ARE ENDANGERED AND ARE
ENTITLED TO PRESERVATION AND PROTECTION AS A MATTER OF
GENERAL STATE CONCERN. THE FEDERAL ENDANGERED SPECIES
ACT OF 1969, 16U.S.C. §668AA-1 ET SEQ., AND THE LACEY
ACT, 18 U.S.C. §§42-44, TOGETHER PROVIDE FOR
PROTECTION OF FISH THREATENED WITH WORLDWIDE
EXTINCTION BY PROHIBITING IMPORTATION OF ENDANGERED
FISH, AND BY RESTRICTING AND REGULATING INTERSTATE AND
FOREIGN COMMERCE IN FISH CAUGHT IN VIOLATION OF STATE,
FEDERAL, AND FOREIGN LAWS. THE STATES, HOWEVER, ALSO
MUST ASSUME RESPONSIBILITY TO CONSERVE ENDANGERED FISH
BY RESTRICTING THE CATCHING, POSSESSING, TRANSPORTING,
