Subsection (i) is new language derived from
Article 66C, section 13A(b) of the Code.
Subsection (j) is new language derived from
Article 96A, section 8 of the Code.
Section 8 was repealed by inadvertence
under Chapter 348, Acts of 1972. This new
section cures this defect. When Article
96A, section 8 was enacted by the
legislature, the determination was made
that it would be more efficient to define
tidal and nontidal boundaries by rule or
regulation than statute. Article 66c,
section 201, which prior to Article 96A,
section 8 set forth these boundaries, is
proposed for repeal in Subtitle 1 as
obsolete. Many of the points of reference
used fail to exist today. Since the
department previously had the power
conferred by this new language, the change
is not considered substantive nor outside
the scope of this revision project.
Article 66C, section 13A(c) appears in
subtitle 6.
Nomenclatural changes pursuant to Chapter
348, Acts of 1972 have been made.
The only other changes made are in style,
4-206. DEPARTMENT'S AUTHORITY OVER PACKERS AND
DEALERS IN RESOURCES - IN GENERAL; REVEALING
INFORMATION IN REPORTS PROHIBITED.
(A) AUDIT BOOKS OF PACKERS OR DEALERS. - THE
DEPARTMENT SHALL AUDIT THE BOOKS OF ANY PERSON WHO
PACKS OR DEALS IN FISH RESOURCES WITHIN THE
JURISDICTION OF THE DEPARTMENT INCLUDING ANYONE WHO
CATCHES AND SHIPS DIRECTLY TO MARKET. THE DEPARTMENT
AUDIT SHALL BE CONDUCTED TO DETERMINE THE QUANTITY OF
RESOURCES CAUGHT AND ANY OTHER DATA NEEDED FOR
REPORTING AND ACCOUNTING TO STATE OFFICIALS.
REVISOR'S NOTE: This subsection presently appears
as Article 66C, section 13E (b) of the Code.

(B) DUTY OF PACKERS OR DEALERS TO KEEP BOOKS AND
ACCOUNTS FOR DEPARTMENT.— EVERY PERSON ENGAGED IN THE
