REVISOR'S NOTE: This section is composed of
several present sections of the Code. It
is intended to enumerate general powers and
functions the department exercises which
transcend only tidal or nontidal water
circumstances.
Subsection (a) is new language derived from
Article 66C, section 13(c) of the Code. A
similar provision appears in Title 8
dealing with water and water resources, see
proposed section 8—203 (c). Article 66c,
section 13 is proposed for repeal in Title
8 because its provisions are incorporated
elsewhere within that title.
Subsection (b) also is new language derived
from Article 66C, section 13(d) of the
Code. A similar provision appears in Title
8 — Water and Water Resources as proposed
section 8-203 (c) .
The first clause of subsection (c) is
derived from the next—to—last provision of
Article 66C, section 12 of the Code.
Section 12 appears in Title 8 Water and
Water Resources as proposed section
8—203(b). The second clause of this
subsection is derived from Article 66C
section 13A(h) of the Code.
Subsection (d) presently appears as Article
66C, section 13E(a) of the Code.
The first sentence of subsection (e)
presently appears as Article 66C, section
236 of the Code. The balance of the
section appears in subtitle 4 dealing with
fish hatcheries.
Subsection (f) is new language derived from
Article 66C, section 13A(d) of the Code.
Subsection (g) is new language derived from
Article 66C, section 13A(e) of the Code.
Subsection (h) is new language derived from
Article 66C, section 13A(j) of the Code.
