section are transferred without change from
one article of the present Code to another
article cf the present Code. Sometimes, this
is done to facilitate the elimination of an
entire article of the present Code (e.g. Art.
26). In every case, the transfer is
consistent with the organization of the
proposed revised code.
Art. 16, §131 requires the indexing of
certain decrees before they become liens on
real property. It is transferred to a
portion cf Art. 21 requiring the indexing of
other records.
Art. 17, §5 directs the maintenance of a
creditors' docket. It is transferred to Art.
47, "Insolvents".
Art. 24, §7, while possibly obsolete, may
contain certain protections for acquitted
defendants. It is transferred to Art. 38,
which deals generally with payment of fines
and costs in criminal cases.
Art. 26, §128A defines a crime of payment of
District Court fines or costs by a bad check.
It is also transferred to Art. 38. The
General Assembly might wish to consider
making this provision apply to all courts.
Art. 26, §§ 132-138 constitute the Review of
Criminal Sentences Act. Since this Act deals
exclusively with criminal law, it is placed
in Art. 27.
Art. 26, §159 provides for a juvenile
probationary school in Baltimore County.
Since by its terms, this section covers
certain criminal offenders generally, and is
not limited to motor vehicle offenders, it is
transferred to Art. 27; compare Art. 66 1/2,
§6-205.3 (Ch. 643, Acts of 1973) which deals
only with traffic schools.
Art. 42, §18, containing restriction or
change of custody of a prisoner, is placed in
Art. 27.
Art. 57, §10 is a limitation provision
closely connected to land patent matters. It
