SEC. 5-114. SHORT TITLE.
THIS SUBTITLE MAY BE CITED AS THE MARYLAND
PESTICIDE REGISTRATION AND LABELING LAW.
REVISOR'S NOTE: This section is new language
derived from the first sentence of Art. 48,
§129 of the Code. The present provision
referring to this law as the Act "of 1958" is
proposed for deletion as unnecessary. This
is the only pesticide law in the State.
SUBTITLE 2. PESTICIDE APPLICATOR'S LAW.
SEC. 5-201. DEFINITIONS.
(A) IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.
REVISOR'S NOTE: This subsection is new language
used as the standard introductory sentence to
a definition section.
(B) "APPLICATION" MEANS THE SPREADING OF
PESTICIDES, BY CONTRACT OR OTHERWISE, FOR ANY PERSON
OWNING OR RENTING PROPERTY.
REVISOR'S NOTE: This subsection presently appears
as Art. 66C, §110A-1(e) of the Code. The
only changes made are in style.
(C) "CUSTOM APPLICATOR" MEANS ANY PERSON WHO IS
ENGAGED IN THE BUSINESS OF APPLYING BY AIR, GROUND,
HAND, OR MECHANICAL EQUIPMENT, PESTICIDES TO WATER,
LAND, PLANTS, FARM STRUCTURES, OR ANIMALS.
REVISOR'S NOTE: This subsection presently appears
as Art. 66C, §110A-1(g) of the Code. The
second clause is proposed for deletion and a
reference to persons "engaged in the business
of applying" pesticides is added to better
express the legislative intent of this
section and to maintain consistency with
other definitions of this section. The only
other changes made are in style.
