(D) "DEVICE" MEANS ANY INSTRUMENT OR MECHANICAL
DEVICE INTENDED TO TRAP, DESTROY, CONTROL, REPEL, OR
MITIGATE PESTS[[, FUNGI, OR NEMATODES]].
REVISOR'S NOTE: This subsection presently appears
as Art. 66C, §110A-1(f) of the Code. The
last phrase is proposed for deletion as
unnecessary. The present reference to "fungi
or nematodes" is proposed for deletion
because it is encompassed within the
definition of "pest". Sec- 5-201 (e) defines
"pest" as any plant or animal life or virus
the Secretary declares to be a pest. The
only other changes made are in style.
(E) "PEST" MEANS (1) ANY INSECT, SNAIL, SLUG,
RODENT, NEMATODE, FUNGUS, WEED, OR (2) ANY OTHER FORM
OF TERRESTRIAL OF AQUATIC PLANT OR ANIMAL LIFE OR
VIRUS, BACTERIA, OR OTHER MICRO-ORGANISM (EXCEPT
VIRUSES, BACTERIA, OR OTHER MICRO-ORGANISMS ON OR IN
LIVING MAN OR ANY OTHER LIVING ANIMAL) WHICH NORMALLY
IS CONSIDERED TO BE A PEST OR WHICH THE SECRETARY
DECLARES TO BE A PEST.

(F) "PESTICIDE" MEANS (1) ANY SUBSTANCE OR
MIXTURE OF SUBSTANCES INTENDED FOR PREVENTING,
DESTROYING, REPELLING, OR MITIGATING ANY PEST, (2) ANY
SUBSTANCE OR MIXTURE OF SUBSTANCES INTENDED FOR USE AS
A PLANT REGULATOR, DEFOLIANT, OR DESICCANT, AND (3)
ANY SUBSTANCE OR MIXTURE OF SUBSTANCES INTENDED TO BE
USED AS A SPRAY ADJUVANT SUCH AS A WETTING AGENT OR
ADHESIVE.

(G) "PEST CONTROL CONSULTANT" MEANS ANY PERSON
