THE PESTICIDE. THIS SUBTITLE DOES NOT REQUIRE THE
SECRETARY TO REPORT FOR PROSECUTION, OR FOR THE
INSTITUTION OF LIBEL PROCEEDINGS, ANY MINOR VIOLATION
OF THE SUBTITLE WHENEVER HE BELIEVES THAT THE PUBLIC
INTEREST IS BEST SERVED BY A SUITABLE WRITTEN WARNING
NOTICE.

(C)   DUTY OF PROSECUTING ATTORNEY.

THE PROSECUTING ATTORNEY TO WHOM ANY VIOLATION IS
REPORTED SHALL INSTITUTE APPROPRIATE PROCEEDINGS IN
THE PROPER COURT WITHOUT DELAY.

(D)   NOTICE OF JUDGMENTS.

THE SECRETARY SHALL GIVE NOTICE BY PUBLICATION OF
ANY JUDGMENT ENTERED IN ANY ACTION INSTITUTED UNDER
THE AUTHORITY OF THIS SUBTITLE.

REVISOR'S NOTE: Subsections (a) and (b) presently
appear as Art. 48, §134(a) of the Code. In
subsection (b), the present reference to the
"proper prosecuting attorney" is proposed for
deletion and a reference to the State's
attorney is added because he is the proper
prosecuting attorney.

Subsection (c) presently appears as Art. 48,
§134(b) of the Code. Subsection (d)
presently appears as Art. 48, §134(c) of the
Code.

The only other changes made are in style.
SEC. 5-113. PENALTY.

IN ADDITION TO ANY OTHER PENALTY PROVIDED BY THIS
ARTICLE, THE REGISTRATION OF ANY PESTICIDE WITH
REFERENCE TO WHICH ANY VIOLATION HAS OCCURRED SHALL
TERMINATE AUTOMATICALLY IF THE REGISTRANT IS CONVICTED
OF ANY VIOLATION OF THIS SUBTITLE. IF THE
REGISTRATION OF ANY PESTICIDE TERMINATES, THE
PESTICIDE MAY NOT BE REGISTERED AGAIN UNLESS THE
DEPARTMENT DETERMINES THAT THE PESTICIDE, ITS
LABELING, AND OTHER MATERIAL REQUIRED TO BE SUBMITTED
COMPLY WITH THE REQUIREMENTS OF THIS SUBTITLE.

REVISOR'S NOTE: This subsection is new language
derived from the last clause of Art. 48,
§136(c) of the Code. The remaining penalty
provisions of the present statute are omitted
