POISON, WOUND, REMOVE, OR DRIVE OFF ANY GAME BIRD OR
MAMMAL OR ITS YOUNG OR EGGS, WITHOUT THE CONSENT OF
THE OWNER. ALSO, A PERSON MAY NOT HUNT ANY GAME BIRD
OR MAMMAL ON THE PRESERVE OR REFUGE AT ANY TIME WITH
THE USE OF SPOTLIGHT, FLASHLIGHT, SEARCHLIGHT, ANY
ARTIFICIAL LIGHT OR BATTERY, SULPHUR FIRE, SNARE, NET,
DEERLICK, PITFALL, TURKEY BLIND, OR TURKEY PEN OR ANY
OTHER MEANS. A PERSON MAY NOT DESTROY ANY PART OF THE
FENCING ABOUT THE PRESERVE OR REFUGE IN ANY MANNER NOR
ENTER INTO THE PRESERVE OR REFUGE AND DRIVE OR ATTEMPT
TO DRIVE AWAY ANY GAME BIRD OR MAMMAL EXCEPT WITH THE
WRITTEN CONSENT OF THE OWNER OF THE PRESERVE OR
REFUGE.
(B) AIDING AND ABETTING PROHIBITED. - NO PERSON
MAY AID OR ABET ANOTHER TO VIOLATE THE PROVISIONS OF
THIS SECTION.
REVISOR'S NOTE: Subsection (a) presently appears
as Article 66C, section 183 of the Code.
The reference to aiders or abettors is
proposed for deletion in light of
subsection (b) which prohibits aiding and
abetting. The present reference to
roosting game birds is proposed for
deletion because this prohibition is
encompassed within the general prohibition
of this section. In addition, new language
derived from Article 27, section 235 is
added for organizational purposes. The
comma between "sulphur" and "fire" is
proposed for deletion because the only
method of hunting birds or mammals by
sulphur is by sulphur fire. The present
provision in Article 27, section 236 which
makes the prohibitions of this section
applicable to game preserves and refuges
enclosed with fencing six feet in height is
omitted because the analogous prohibition
of Article 66C, section 183 relates to
fencing of any height. Finally, the
reference to daytime or nighttime in the
last sentence of subsection (a) is proposed
for deletion because this prohibition
applies at any time.
Subsection (b) is new language derived from
the reference in the first sentence to
"aiders and abettors".
The only other changes made are in style.
