REVISOR'S NOTE: This subsection presently appears

(3) COMPLAINT AGAINST LICENSEE; PROCEDURE;
HEARING.—ANY PERSON MAY PREFER CHARGES AGAINST ANY
LICENSEE FOR FRAUD, DECEIT, GROSS NEGLIGENCE, IN-
COMPETENCY, MISCONDUCT, OR VIOLATION OF ANY LAW OR
RULE OR REGULATION. THE CHARGES SHALL BE IN WRITING
AND FILED WITH THE BOARD SECRETARY. THE BOARD SHALL
HEAR ANY CHARGE WITHIN THREE MONTHS AFTER IT HAS BEEN
PREFERRED. THE BOARD MAY SUBPOENA WITNESSES, TAKE
[[TESTIMSNY]] TESTIMONY UNDER OATH, REQUIRE THE
PRODUCTION BY WITNESSES OF BOOKS, PAPERS, PUBLIC
RECORDS, AND OTHER DOCUMENTARY EVIDENCE, AND EXAMINE
THEM IN RELATION TO THE CHARGES BEFORE IT. THE BOARD
DETERMINES A TIME AND PLACE FOR THE HEARING. A COPY
OF THE CHARGES, TOGETHER WITH A NOTICE OF THE TIME AND
PLACE OF THE HEARING, SHALL BE SERVED PERSONALLY OR
MAILED TO THE LAST KNOWN ADDRESS OF THE LICENSEE AT
LEAST 30 DAYS BEFORE THE HEARING DATE. AT THE
HEARING, THE LICENSEE MAY APPEAR IN PERSON OR BY
COUNSEL, CROSS-EXAMINE WITNESSES, AND PRODUCE EVIDENCE
AND WITNESSES IN HIS OWN DEFENSE.

(C) REISSUANCE OF SUSPENDED OR REVOKED

LICENSE.--___THE BOARD MAY REISSUE A LICENSE TO ANY

PERSON WHOSE LICENSE HAS BEEN SUSPENDED OR REVOKED, BY
A VOTE OF FIVE OR MORE MEMBERS IN FAVOR OF THE
REISSUANCE.

8-612. RECIPROCITY FOR WELL DRILLER'S LICENSES.

THE BOARD MAY ENTER INTO RECIPROCAL AGREEMENTS
WITH THE LICENSING AGENCIES OF OTHER STATES IN ORDER
TO ISSUE WITHOUT FEE OR EXAMINATION A LICENSE
QUALIFYING A WELL DRILLER TO PRACTICE IN THE OTHER
STATE TO ENGAGE IN THE BUSINESS OF WELL DRILLING IN
THIS STATE. IF NO RECIPROCAL ARRANGEMENT IS MADE, THE
NONRESIDENT WELL DRILLER SHALL MEET THE STATE
REQUIREMENTS IN ORDER TO OBTAIN A LICENSE.
