(C) TEMPORARY LICENSE.—IN ACCORDANCE WITH ANY
RULE OR REGULATION THE BOARD MAY PRESCRIBE, THE BOARD
SECRETARY MAY ISSUE A TEMPORARY LICENSE TO ANY PERSON
WHO FILES AN APPLICATION IN PROPER FORM AND PAYS THE
ANNUAL LICENSE FEE. A TEMPORARY LICENSE SHALL EXPIRE
AT THE TIME THE BOARD EITHER REFUSES TO ISSUE OR GRANT
THE LICENSE, AND IS SUBJECT TO TERMINATION BY THE
BOARD SECRETARY AT ANY TIME PRIOR TO THE BOARD'S
ACTION.

(E) BOND AND INSURANCE REQUIREMENTS FOR
LICENSES.—THE BOARD SHALL REQUIRE ANY PERSON WHO
ENGAGES OR INTENDS TO ENGAGE IN THE BUSINESS OF WELL
DRILLING IN THIS STATE TO CARRY A UNIFORM REASONABLE
PERFORMANCE BOND AND REASONABLE CONTRACTORS' LIABILITY
INSURANCE. THE BOARD SHALL DETERMINE THE FORMAT AND
DOLLAR VALUE OF THE BOND AND INSURANCE. THEY ARE A
CONDITION PRECEDENT TO ISSUING OR RENEWING A
WELL-DRILLER'S LICENSE. A POLITICAL SUBDIVISION MAY
NOT REQUIRE A PERSON TO OBTAIN ANY PERFORMANCE BOND OR
CONTRACTORS' LIABILITY INSURANCE AS A CONDITION TO
ENGAGE IN THE BUSINESS OF WELL DRILLING IN THE
POLITICAL SUBDIVISION.

8-611. SUSPENSION OR REVOCATION OF WELL DRILLER'S
LICENSE; REISSUANCE; APPEALS.

(A) GROUNDS FOR SUSPENSION OR REVOCATION OF
LICENSE.—THE BOARD SHALL REVOKE OR SUSPEND THE
LICENSE OF ANY WELL DRILLER WHO, UPON HEARING BY THE
BOARD, IS FOUND GUILTY OF FRAUD OR DECEIT IN OBTAINING
HIS LICENSE OR GROSS NEGLIGENCE, INCOMPETENCE, OR
MISCONDUCT IN THE BUSINESS OF WELL DRILLING. THE
BOARD MAY SUSPEND OR REVOKE THE LICENSE OF A WELL
DRILLER IF IT FINDS THERE HAS BEEN A VIOLATION OF THE
PROVISIONS OF PART III OF THIS SUBTITLE, ANY RULE OR
REGULATION THE SECRETARY PROMULGATES PURSUANT TO IT OR
ANY RULE OR REGULATION OF ANY OTHER DEPARTMENT ADOPTED
AS APPLICABLE TO THE BUSINESS OF WELL DRILLING.
