92                                          LAWS OF MARYLAND                                 Ch. 59

PROMULGATED BY A NATIONALLY RECOGNIZED STANDARDS
PRODUCING ORGANIZATION.

(H) "ESTABLISHED FEDERAL STANDARD" MEANS ANY
OCCUPATIONAL SAFETY AND HEALTH STANDARD ESTABLISHED
BY ANY AGENCY OF THE UNITED STATES AND PRESENTLY IN
EFFECT.

(I) "BOARD" MEANS OCCUPATIONAL SAFETY AND HEALTH
ADVISORY BOARD.

30. POWERS OF THE COMMISSIONER.

(A)     THE COMMISSIONER SHALL HAVE THE POWER AND
AUTHORITY TO ADMINISTER AND ENFORCE THE PROVISIONS OF
THIS SUBTITLE AND SHALL PRESCRIBE SUCH RULES AND
REGULATIONS AS HE MAY DEEM NECESSARY TO CARRY OUT HIS
RESPONSIBILITIES UNDER THIS SUBTITLE.

(B)  THE COMMISSIONER OR HIS AUTHORIZED REPRESENTATIVE,
IN THE PERFORMANCE OF ANY DUTY OR THE EXECUTION OF ANY
POWER PRESCRIBED BY THIS SUBTITLE, SHALL HAVE THE POWER
TO ADMINISTER OATHS, CERTIFY AS TO OFFICIAL ACTS, TAKE
AND CAUSE TO BE TAKEN DEPOSITION OF WITNESSES, ISSUE
SUBPOENAS, AND COMPEL THE ATTENDANCE OF WITNESSES AND
PRODUCTION OF PAPERS, BOOKS, DOCUMENTS, RECORDS AND
TESTIMONY. IN CASE OF FAILURE OF ANY PERSON TO COMPLY
WITH A SUBPOENA LAWFULLY ISSUED, OR ON THE REFUSAL OF
ANY WITNESS TO PRODUCE EVIDENCE OR TO TESTIFY TO ANY
MATTER REGARDING WHICH HE MAY BE LAWFULLY
INTERROGATED, IT SHALL BE THE DUTY OF A COURT OF
COMPETENT JURISDICTION OR THE JUDGE THEREOF, IN THE
POLITICAL SUBDIVISION IN WHICH THE PERSON OR WITNESS
RESIDES OR IS THEN PRESENT, AND UPON THE APPLICATION OF
THE COMMISSIONER OR HIS AUTHORIZED REPRESENTATIVE, TO
COMPEL OBEDIENCE BY PROCEEDINGS FOR CONTEMPT, AS IN THE
CASE OF DISOBEDIENCE OF THE REQUIREMENTS OF A SUBPOENA
ISSUED BY SUCH COURT OR A REFUSAL TO TESTIFY THEREIN.

(C)        THE COMMISSIONER SHALL CONDUCT, AFTER
CONSULTATION WITH OTHER APPROPRIATE DEPARTMENTS AND
AGENCIES (1) EDUCATION PROGRAMS TO PROVIDE AN ADEQUATE
SUPPLY OF QUALIFIED PERSONNEL TO CARRY OUT THE INTENT
AND PURPOSES OF THIS SUBTITLE, (2) INFORMAL PROGRAMS ON
THE IMPORTANCE OF AND PROPER USE OF ADEQUATE SAFETY
AND HEALTH EQUIPMENT, AND (3) CONDUCT TRAINING OF
PERSONNEL ENGAGED IN WORK RELATED TO THE
RESPONSIBILITIES OF THE COMMISSIONER UNDER THIS SUBTITLE.

(D)     THE COMMISSIONER SHALL (1) PROVIDE FOR THE
ESTABLISHMENT AND SUPERVISION OF PROGRAMS FOR THE
EDUCATION AND TRAINING OF EMPLOYERS AND EMPLOYEES IN
THE RECOGNITION, AVOIDANCE AND PREVENTION OF UNSAFE OR
UNHEALTHFUL WORKING CONDITIONS IN EMPLOYMENTS
COVERED BY THIS SUBTITLE. AND (2) CONSULT WITH AND ADVISE
EMPLOYERS AND EMPLOYEES, AND ORGANIZATIONS
REPRESENTING EMPLOYERS AND EMPLOYEES AS TO EFFECTIVE
MEANS OF PREVENTING OCCUPATIONAL INJURIES AND
