CHAPTER 444
(Senate Bill 862)

AN ACT to add new Section 16-16A to the Code of Public Local Laws of
Baltimore City, (1969 Edition, being Article 4 of the Code of Public Local Laws
of Maryland), title "Baltimore City," subtitle "Police Department," to follow
immediately after Section 16-16 thereof: to [[require]] allow the Police
Commissioner of Baltimore City to appoint [[police]] special sanitary
enforcement officers to issue summonses on building, public health and
sanitation ordinance violations and summonses on reported violations of State
laws and regulations in this area, and I ho allow the Commissioner to
promulgate the composition, duties, functions and procedures of these
officers.]] generally relating to such officers and their status and functions.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 16-16A be and it is hereby added to the Code of
Public Local Laws of Baltimore City, (1969 Edition, being Article 4 of the Code of
Public Local Laws of Maryland), title "Baltimore City," subtitle "Police
Department," to follow immediately after Section 16-16 thereof and to read as
follows:

16-16A.

(A)   THE COMMISSIONER [[SHALL APPOINT POLICE OFFICERS IN
THE DEPARTMENT AS SPECIAL SANITARY OFFICERS]] MAY
APPOINT PERSONS AS SPECIAL SANITARY ENFORCEMENT
OFFICERS OF AGENCIES OF THE CITY OF BALTIMORE DESIGNATED
BY ORDINANCE, AND THE ORDINANCES ALSO MAY PROVIDE FOR
THEIR DUTIES, FUNCTIONS, AND PROCEDURES AS SPECIAL
OFFICERS HEREUNDER. THE OFFICERS APPOINTED UNDER THIS
SECTION MAY ISSUE SUMMONSES TO APPEAR BEFORE THE
APPROPRIATE DIVISION OF THE DISTRICT COURT IN CASES OF
VIOLATION OF ANY CITY ORDINANCE PERTAINING TO THE
BUILDING CODE, PUBLIC HEALTH, AND SANITATION.

(B)        THESE OFFICERS SHALL RECEIVE COMPLAINTS AND
INVESTIGATE ALL VIOLATIONS OF THE ORDINANCES IN
SUBSECTION (A), AND ALSO ALL VIOLATIONS REPORTED TO THEM
BY ANY STATE DEPARTMENT OR AGENCY [[IF]] OF ANY STATE
LAW OR REGULATION CONCERNING BUILDINGS, PUBLIC HEALTH
OR SANITATION.

[[(C)           THE COMPOSITION, DUTIES, FUNCTIONS, AND

PROCEDURES FOR THESE OFFICERS SHALL BE PROMULGATED BY
THE COMMISSIONER.]] THE OFFICERS MAY NOT ARREST OR TAKE
INTO CUSTODY ANY VIOLATOR OF SUCH ORDINANCES OR
OTHERWISE HAVE THE POWER OF ARREST IN THEIR OFFICIAL
CAPACITY. A RECORD OF APPOINTMENT OF OFFICERS SHALL BE
KEPT BY THE COMMISSIONER AND ANY APPOINTMENT MAY BE
REVOKED BY HIM AT ANY TIME THE FORM OF BADGE AND THE
TYPE OF UNIFORM THAT MAY BE WORN BY THE SPECIAL
SANITARY ENFORCEMENT OFFICERS MUST BE APPROVED BY THE
POLICE COMMISSIONER.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
