CHAPTER 445
(Senate Bill 866)

AN ACT to add new Section 268A to Article 27 of the Annotated Code of
Maryland (1971 Replacement Volume and 1972 Supplement), title "Crimes and
Punishments," subtitle "Crimes and Punishments,'" subheading "Gunning," to
follow immediately after Section 268 thereof, to require written permission or
license from a landowner in Talbot County before a person is allowed to hunt
on that land and providing penalties for violation thereof.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 268A be and it is hereby added to Article 27 of
the Annotated code of Maryland (1971 Replacement Volume and 1972
Supplement), title "Crimes and Punishments," subtitle "Crimes and Punishments,"
subheading "Gunning", to follow immediately after Section 268 thereof and to
read as follows:

268A.

IN TALBOT COUNTY EVERY PERSON WHO HUNTS WITH GUN OR
OTHER WEAPON UPON THE LANDS OF ANOTHER WITHOUT FIRST
OBTAINING WRITTEN PERMISSION OR LICENSE FROM THE OWNER
OR POSSESSOR OF SAID LAND SHALL BE GUILTY OF A
MISDEMEANOR AND UPON CONVICTION FOR THE FIRST SUCH
OFFENSE SHALL BE FINED BY THE JUDGE OF THE DISTRICT COURT
NOT LESS THAN TWO HUNDRED AND FIFTY DOLLARS ($250.00) OR
MORE THAN ONE THOUSAND DOLLARS ($1,000.00). IN THE EVENT
OF ANY FAILURE TO PAY A FINE, FURTHER PROCEEDINGS SHALL
BE HAD PURSUANT TO ARTICLE 38, SECTION 4. UPON THE SECOND
OR ANY SUBSEQUENT CONVICTIONS FOR THE SAME OFFENSE, THE
PERSON SHALL BE FINED NOT LESS THAN FIVE HUNDRED
DOLLARS ($500.00) OR MORE THAN TWO THOUSAND DOLLARS
($2,000.00); PROVIDED, HOWEVER, THAT THE PERSON OR PERSONS
CONVICTED BY THE DISTRICT COURT SHALL HAVE THE RIGHT TO
APPEAL TO THE CIRCUIT COURT WITHIN THIRTY DAYS FROM THE
DATE OF CONVICTION.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
