AN ACT to add new Section 233B to Article 27 of the Annotated Code of
Maryland (1971 Replacement Volume), title "Crimes and Punishments,"
subtitle "I. Crimes and Punishments," to follow immediately after Section 233A
thereof and to be under the new subheading "Fraud-Horse Races," to make it
unlawful for anyone to enter or race a horse under a false name [[or out of its
proper class]] and to provide penalties therefor.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 233B be and it is hereby added to Article 27 of
the Annotated Code of Maryland (1971 Replacement Volume), title "Crimes and
Punishments," subtitle "I. Crimes and Punishments," to follow immediately after
Section 233A thereof and to be under the new subheading "Fraud-Horse Races,"
and to read as follows:

233B.

FRAUD-HORSE RACES

ANY PERSON WHO KNOWINGLY ENTERS OR RACES A HORSE IN
ANY RUNNING OR TROTTING RACE UNDER [[OTHER THAN ITS
TRUE NAME OR OUT OF ITS PROPER CLASS OR WHO KNOWINGLY
SETS ON FOOT,]] ANY NAME OR DESIGNATION OTHER THAN THE
NAME OR DESIGNATION ASSIGNED TO THE HORSE BY AND
REGISTERED WITH THE JOCKEY CLUB OR THE UNITED STATES
TROTTING ASSOCIATION OR INSTIGATES. ENGAGES IN, OR IN ANY
WAY FURTHERS ANY ACT BY WHICH A HORSE IS ENTERED OR
RACED IN ANY RUNNING OR TROTTING RACE UNDER [[OTHER
THAN ITS TRUE NAME]] ANY NAME OR DESIGNATION OTHER
THAN THE NAME OR DESIGNATION ASSIGNED TO THE HORSE BY
AND REGISTERED WITH THE JOCKEY CLUB OR THE UNITED
STATES TROTTING ASSOCIATION IS GUILTY OF A MISDEMEANOR
AND UPON CONVICTION THEREOF SHALL BE SUBJECT TO A FINE
OF NOT LESS THAN ONE HUNDRED DOLLARS ($100.00) NOR MORE
THAN FIVE THOUSAND DOLLARS ($5,000.00).

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
