208.

No other provision in any other statute which provides wholly or partly at the
expense of the State of Maryland for pensions or retirement benefits for teachers
of the [said] State, their [widows] SURVIVING SPOUSES or other dependents,
shall apply to members or beneficiaries of the retirement system established by this
subtitle, their [widows] SPOUSES or other dependents, except benefits from
social security.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 381
(Senate Bill 299)

AN ACT to repeal and re-enact, with amendments, Section 24 of Article 78B of
the Annotated Code of Maryland (1969 Replacement Volume), title "Racing
Commission," subtitle "In General," to eliminate references to a particular sex
in the racing laws and to correct language.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 24 of Article 78B of the Annotated Code of
Maryland (1969 Replacement Volume), title "Racing Commission," subtitle "In
General," be and it is hereby repealed and re-enacted, with amendments, to read
as follows:

24.

The Maryland Racing Commission is hereby authorized to pay over to the
Maryland Horsemen's Assistance Fund, Inc., a charitable corporation organized
for the benefit, aid, assistance and relief of horsemen, trainers, jockeys, exercise
[boys] RIDERS, grooms, stable attendants and other persons employed in
connection with the racing of horses or their [widows] SPOUSES or children, who
are in need of financial assistance, for these aforementioned corporate purposes,
and no other purpose, all monies held by the Maryland Racing Commission on
June 1, 1949 in a special fund known as the Relief Fund of the Maryland Racing
Commission as created by Chapter 786, Laws of 1947, and all fines and penalties
and overpayments on the tote machines hereafter collected, except [such] THE
fines and penalties as may be imposed upon associations. [Such] THE fines,
penalties and overpayments shall be collected by the clerk of the course and shall
be paid to the Maryland Racing Commission within ten days after the close of
each race meet and shall be paid by the Commission to Maryland Horsemen's
Assistance Fund, Inc., on or before December 31 in each year, provided that no
payments shall be made by the Commission to Maryland Horsemen's Assistance
Fund, Inc., unless the Commission in its discretion, is satisfied that [said] THE
corporation is, in all respects, being operated for the above-mentioned charitable
and benevolent purposes, as set forth in its original charter, and that no part of the
funds paid to [said] THE corporation by the Commission or any net earnings of
[said] THE corporation inure to the benefit of any private individual, director,
officer or member of [said] THE corporation.
