paid for the period of his or her natural life unless he or she remarries, in which
event the special allowance is immediately to cease and terminate. The board of
trustees is hereby authorized and directed, subject to the annual appropriation of
the necessary funds, to make special allowance herein provided for, provided that
the application of this section shall be limited to the surviving spouses of teachers
whose death did not entitle such surviving spouses to any continuing retirement or
pension benefits under the provisions of this subtitle other than as provided in this
section. ]

SECTION 2. AND BE IT FURTHER ENACTED, That the provisions of this
Act shall be construed only prospectively and shall not be applied nor interpreted
to have any effect upon or application to any person presently receiving a
retirement or pension benefit under this section.

SECTION 3. AND BE IT FURTHER ENACTED, That subject to the
provisions of Section 2, this Act shall take effect July 1, 1973.

CHAPTER 372
(Senate Bill 243)

AN ACT to repeal and re-enact, with amendments, Section 53(12) of Article 88B
of the Annotated Code of Maryland (1969 Replacement Volume), title "State
Police," subtitle "State Police Retirement System," [[amending the retirement
law to exclude from a special survivor benefit any type of cost-of-living
adjustment that the federal government may enact.]] to provide that survivor's
benefits under the State Police pension system not include any federal
cost-of-living adjustment.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 53(12) of Article 88B of the Annotated Code of
Maryland (1969 Replacement Volume), title "State Police," subtitle "State Police
Retirement System," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

53.

(12) Benefits to survivors upon death after service or ordinary disability
retirement. — Upon the receipt of proper proofs of the death of a member who was
retired under the provisions of subsection (1) or (3) of this section on or after July
1, 1965, there shall be paid child's insurance benefits, widow's insurance benefits,
mother's insurance benefits, parents' insurance benefits and lump-sum death
payments which are computed and paid in accordance with the provisions of Title
II of the federal Social Security Act as in effect at the time of payment, provided
that the average monthly wage upon which such benefits are based is deemed to be
the lesser of one twelfth the member's average final compensation or the maximum
average monthly wage then in effect. THE AMOUNT OF BENEFITS
PAYABLE UNDER THIS SUBSECTION SHALL NOT INCLUDE ANY
TYPE OF COST-OF-LIVING ADJUSTMENTS THAT THE FEDERAL
GOVERNMENT MAY [[ENACT]] PROVIDE.
