SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 373
(Senate Bill 250)

AN ACT to repeal and re-enact, with amendments, Section 19-2 of Article 33 of
the Annotated Code of Maryland (1971 Replacement Volume), title "Election
Code," subtitle "Contested Elections," to authorize a court to declare null and
void all or part of an election under certain circumstances and relating generally
[[thereto.]] to evaluation by certain courts of detrimental conduct of certain
election officials and certain remedies.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 19-2 of Article 33 of the Annotated Code of
Maryland (1971 Replacement Volume), title "Election Code," subtitle "Contested
Elections," be and it is hereby repealed and re-enacted, with amendments, to read
as follows:

19.2.

All cases of contested elections of any of the officers not provided for in the
Constitution or in §§ 19-1 and 19-4 of this article, shall be decided by the judges
of the several circuit courts, each in his respective circuits, or by the Superior
Court of Baltimore City, in the City of Baltimore. IF THE COURT FINDS
THAT MECHANICAL FAILURE, FRAUD OR NEGLIGENCE ON THE
PART OF ANY ELECTION OFFICIAL OR [[OTHER THIRD PARTY]]
[[THEIR]] HIS AGENT MATERIALLY CONTRIBUTED TO THE
OUTCOME OF [[THE]] THAT PARTICULAR ELECTION, SUCH THAT
WOULD AFFECT THE FINAL RESULT , THE COURT BY ORDER MAY
DECLARE NULL AND VOID ALL OR PART OF [[THE]] THAT
PARTICULAR ELECTION, AND THE COURT MAY FURTHER ORDER
THAT ALL OR PART OF [[THE]] THAT PARTICULAR ELECTION BE
REHELD.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

AN ACT to repeal and re-enact, with amendments, Section 57(d) of Article 77A
of the Annotated Code of Maryland (1969 Replacement Volume [[and 1972
Supplement]]), title "Higher Education," subtitle "Scholarships," to permit
General State scholarship units to be used to defray all or part of the costs of
