618                                     LAWS OF MARYLAND                              Ch. 243

THOSE CHILDREN AND YOUNG ADULTS ATTENDING PUBLIC
EDUCATIONAL FACILITIES; AND

(3) SUFFICIENT QUALIFIED MENTAL HEALTH PROFESSIONALS,
TEACHERS, AND PERSONNEL WITH SPECIALIZED SKILLS IN THE
EDUCATION AND TREATMENT OF CHILDREN AND YOUNG ADULTS
WITH MENTAL DISORDERS.

(G) EACH PATIENT TO BE DISCHARGED SHALL BE PROVIDED A
POST-HOSPITALIZATION PLAN, INCLUDING BUT NOT LIMITED TO:

(1)     RECOMMENDATIONS FOR AFTERCARE MEDICAL AND
PSYCHIATRIC CONSULTATION AT APPROPRIATE COMMUNITY
MENTAL HEALTH CENTERS, TAKING INTO ACCOUNT THE NATURE
OF THE PATIENTS PROBLEM, NEED FOR CONTINUING CARE AND
SUPERVISION, PLACE OF RESIDENCE AND FINANCIAL
CAPABILITIES; AND

(2)  RECOMMENDATIONS FOR RESIDENTIAL HOUSING UPON THE
PATIENT'S DISCHARGE; AND

(3)         PROVISIONS FOR IMPLEMENTATION OF THE
POST-HOSPITALIZATION PLAN.

19.

(A)   Each facility which has, as patients, any persons admitted under the
provisions of this subtitle, shall make and retain in a separate and secure area of
the facility, complete records of each [such] patient. [Such] THE records shall
contain copies of all data required by this article, and [such] ANY additional
information las may be] required by the Department. [Such records shall be
opened for inspection by persons] THE COMPLETE PATIENT RECORD
SHALL BE AVAILABLE TO ANYONE INCLUDING THE PATIENT,
PROPERLY AUTHORIZED IN WRITING BY THE PATIENT, HIS
AGENT, DULY APPOINTED GUARDIAN, OR ANYONE designated by the
Commissioner and in accordance with the provisions of the Privileged
Communications Act, Article 35, § 13A, but shall be closed to all other persons.

(B)  THESE RECORDS SHALL INCLUDE, BUT ARE NOT LIMITED TO:

(1)   IDENTIFICATION DATA, INCLUDING THE LEGAL BASIS FOR
THE PATIENT'S ADMISSION; AND

(2)  THE PATIENT'S HISTORY INCLUDING, BUT NOT LIMITED TO,
PRIOR MEDICAL HISTORY, BOTH PHYSICAL AND MENTAL,
INCLUDING PRIOR HOSPITALIZATION; RELEVANT FAMILY DATA,
BOTH MEDICAL, PSYCHIATRIC AND PERSONAL; EDUCATIONAL
BACKGROUND; AND EMPLOYMENT HISTORY; AND

(3)   A COPY OF THE INDIVIDUALIZED TREATMENT PLAN AS
DESCRIBED IN SECTION 22A, INCLUDING THE INDIVIDUALIZED
EDUCATIONAL PLAN, WHERE MADE APPLICABLE BY SUBSECTION
(F) OF SECTION 22A OF THIS TITLE, AND ANY MODIFICATIONS
THERETO; AND

(4)  A DETAILED SUMMARY ON A WEEKLY BASIS BY A QUALIFIED
MENTAL HEALTH PROFESSIONAL INVOLVED IN THE PATIENT'S
TREATMENT OF THE PATIENT'S PROGRESS UNDER THE
TREATMENT PLAN; AND
