SECTION 7. AND BE IT FURTHER ENACTED, That where decreases have
been made in the appropriations for the various departments, boards, commissions,
agencies, divisions and institutions as a result of a reduction in the objects of
expense for travel, communication, and motor vehicle operation made throughout
the State government as outlined in documents outlining action by the General
Assembly on appropriations, the decreases shall be made in those objects of
expense and the effect of these decreases may be shifted among the various
appropriations for programs within the departments, board, commissions, agencies.
divisions and institutions, including the Department of Transportation in
accordance with the provision of Section 8 of Article 15A of the Annotated Code
of Maryland.

SECTION_8._AND BE IT FURTHER ENACTED, That immediately
following the close of each fiscal year the Secretary of Budget and Fiscal Planning
shall determine the total number of State positions that are authorized as of the
last day of the fiscal year. Authorized positions shall include all budget positions as
shown in the personnel detail of the annual budget for the ensuing fiscal year
including non-budget programs, the Mass Transit Administration, the University
of Maryland self-supported activities, and the State-Use Industries. The Board of
Public Works, in exercising its authority to create additional positions pursuant to
Sec. 16B of Article 78A. may authorize, during any fiscal year, up to five hundred
(500) positions in excess of the total number of authorized State positions as
determined by the Secretary of Budget and Fiscal Planning on the last day of any
fiscal year. Provided, however, that if the imposition of this ceiling causes undue
hardship in any particular department, agency, board, or commission, the Board of
Public Works may authorize additional positions for such department, agency,
board, or commission, upon the elimination of [[other]] an equal number of
authorized positions in another department, agency, board, or commission, and
said action shall be exempt from the aforementioned ceiling of five hundred (500),
Notwithstanding anything contained in this Section the Board of Public Works
may authorize additional temporary positions to meet public emergencies resulting
from an act of God and violent acts of men which are necessary to protect the
health and safety of the people of Maryland.
