MONTGOMERY COUNTY
County Attorney or his authorised designee certify the
matter to the County Attorney to bring any action
necessary to preserve such status quo or to prevent
such irreparable harm, including but not limited to
temporary restraining orders and preliminary
injunctions.
SECTION 5. Section 77-19 of the Montgomery
County Code 1965, title "licensing and licensing
Authorities," is hereby amended by adding a new
subsection (c) thereto to follow immediately after
subsection (b) thereof to read as follows:
(C) WHEN A COMPLAINT IS FILED UNDER SECTION
77-15 OF THIS ARTICLE AGAINST A PERSON LICENSEE BY THE
REAL ESTATE COMMISSION OF MARYLAND AND THE EXECUTIVE
SECRETARY SHALL FIND THAT REASONABLE GROUNDS EXIST TO
BELIEVE THE LAW HAS BEEN VIOLATED, THE EXECUTIVE
SECRETARY SHALL TRANSMIT PROMPTLY A COPY OF HIS
FINDINGS AND THE COMPLAINT TO THE REAL ESTATE
COMMISSION OF MARYLAND FOR SUCH ACTION AS THE SAID
COMMISSION, IN ITS JUDGEMENT, CONSIDERS APPROPRIATE.
THE EXECUTIVE SECRETARY SHALL PROMPTLY FORWARD TO THE
REAL ESTATE COMMISSION THE FINAL DISPOSITION OF
COMPLAINTS PREVIOUSLY FORWARDED TO THE COMMISSION.
SECTION 6. Section 77-20 of the Montgomery
County Code 1965, title "Penalties," is hereby
repealed and re—enacted, with amendments, to read as
follows:
77-20. Penalties.
(a) Any person who shall be found to have
committed a violation of any of the provisions of this
Article relating to discrimination practices or any
rule or regulations herein pertaining thereto, shall
be subject to injunctive or other appropriate action
or proceeding to correct any violation of this
Article, and any court of competent jurisdiction may
issue restraining orders, temporary or permanent
injunctions or other appropriate forms of relief.
(b) Should any person be found by a court of
competent jurisdiction to have failed to comply with a
consent agreement under Section 77—17 (b), or with a
summons under Section 77-17(f), or with a Commission
order under Section 77-17(g), he shall be subject to a
fine up to $1,000 and costs.
