UNDER SUBSECTION (1) OF THIS SECTION.
SECTION 2. Section 77-15 of the Montgomery
County Code 1965, title "Filing of Complaints," is
hereby repealed and re—enacted, with amendments, to
read as follows:
77—15. Filing of Complaints.
Any person himself subjected to a discriminatory
act or practice in violation of this Article or any
group or person acting on his behalf may file with the
Commission Panel, or the Human Relations Commission
upon recommendation of a majority of the remaining
members, may initiate a complaint in writing, sworn to
or affirmed, which shall state the name and address of
the person alleged to have committed the violation
complained of and the particulars thereof, and such
other information as may be required by the Commission
Panel. The Commission may also corroborate or
initiate complaints on the basis of testing carried
out by its staff or volunteers authorized by the
Commission.
SECTION 3. Section 77-17 of the Montgomery
County Code 1965, title "Procedures and Enforcement,"
subsection (e) thereof is hereby repealed and
re—enacted, with amendments, to read as follows:
(e) If the Executive Secretary determines that
the complaint lacks reasonable grounds upon which to
base a violation of this Article, he shall so inform
the Commission Panel and the Commission Panel may in
its discretion dismiss such complaint or order such
further investigation as may be necessary, provided,
however, that the Commission Panel shall not dismiss
such complaint without first affording the complainant
an opportunity to appear before the Commission Panel.
SECTION 4. Section 77-17 of the Montgomery
County Code 1965, title "Procedures and Enforcement,"
subsection (h) thereof is hereby repealed and
re—enacted, with amendments, to read as follows:
(h) At any time after a complaint has been
filed, when the Commission Panel believes that
appropriate civil action to preserve the status quo or
to prevent irreparable harm appears advisable, the
Commission Panel may after consultation with the
