COUNTY LOCAL LAWS

Upon completion of five (5) years of County service
for each member appointed prior to June 30, 1970 or
five (5) years of continuous County service for each
member appointed on or after July 1, 1970, each member
who does not qualify for credited service under the
provisions of Section 94-65(c)(1) and (2), title
"Credited service for period of service in the Armed
Forces of the United States," may obtain credited
service under the Employees' Retirement System of
Montgomery County for all or part of any period of
military service in the armed forces of the United
States not in excess of thirty-six (36) months. This
option for purchase of such service credits must be
exercised by a member with five or more years of
qualified County service by September 30, 1972.
Thereafter this option must be exercised by a member
within thirty (30) days of his fifth anniversary date
of continuous service as a County employee. Any
employee transferring from Retirement Group D to
Retirement Group E on or before September 30, 1972 and
any employee having five or more years of County
service as of September 30, 1972 may purchase up to
four years of creditable service. Any compensatory
leave payments or cash payments, including interest
charges that may be in excess of the amount that would
be payable under the revised provisions of this
section shall be returnable immediately to such
employee with four percent (4%) interest.

(j) Payment of Contributions for credited service
for prior military service. Before being credited for
this service, such member shall pay into the
Employees' Retirement System of Montgomery County, in
a lump sum or on an extended payment basis, an amount
determined by multiplying the salary being paid him on
the day before his fifth (5) anniversary of County
service by the percentage of his member contributions
for each full year of prior military service he wishes
to purchase for credited service and a pro rata amount
for each period of less than one (1) year. In
addition, the member shall pay on such sum four
percent (4%) interest per annum from the date of his
fifth anniversary of continuous County service to July
1, 1970, or such earlier date the member has fully
purchased his prior military service. Thereafter
interest at the rate of not less than six and one-half
percent (6 1/2%) per annum will be charged. If a
member wishes to purchase such credited service on an
extended payment basis, he must obtain the approval of
the County Personnel Board. Notwithstanding the above
