month elected by the member after he satisfies all of
the following requirements;

(1)   Group A. Any Group A member with at
least five (5) years of creditable service who has
reached his sixtieth (60) birthday or any Group A
member who has reached his fifty—fifth (55) birthday
and who has at least thirty (30) years of creditable
service.

(2)  Group B. Any Group B member with at
least fifteen (15) years of creditable service who is
at least fifty-five (55) years of age or any Group B
member with at least thirty (30) years of creditable
service who is at least fifty-one (51) years of age.

(3)  Group C. Any Group B, D, or E member
who has not reached his normal retirement date, who is
no longer able to perform the duties of his position
as a result of a service-connected disability and who
in consideration thereof transfers to another
full—time County position covered under Group A shall
retain the normal retirement date he had under the
Group from which he transfers.

(4) Group D. Any Group D member covered
under the provisions of the Police Relief and
Retirement Fund of Montgomery County, Fart II of this
retirement system, who has served as a Montgomery
County Police Officer for at least twenty-five (25)
years irrespective of age or if not qualified under
the Police Relief and Retirement Fund of Montgomery
County for such retirement, any Group D member with
twenty-five (25) years of service as a Montgomery
County Police Officer who has attained the age of
fifty-five (55) years.

(5) Group E. Any Group E member with at
least fifteen (15) years of creditable service who is
at least fifty-five (55) years of age or any Group E
member with at least twenty—five (25) years of
creditable service who is at least forty—six (46)
years of age.

There will be no refund of contributions to any
employee who transfers from one membership group to
another membership group having a lower contribution
rate or different benefits.
