Fire Department, Inc., and to exercise such other
authority as is vested in it by law. The Board of
Trustees of the Upper Montgomery County Volunteer Fire
Department, Inc., and their successors shall
constitute the Fire Board.

SECTION 14. Chapter 85, title "Fire
Departments," of the Montgomery County Code 1965, as
amended, is hereby repealed in its entirety.

SECTION 15. Prior bond issues. Nothing in this
Act shall be construed in any way to impair (1) the
validity of any action taken by Montgomery County
heretofore with respect to any bonds issued for any
purpose with respect to any fire taxing area; (2) the
validity of any such bonds; or (3) the obligation of
Montgomery County, Maryland, to levy ad valorem taxes
upon all assessable property within the corporate
limits of the County, in each fiscal year in which any
of such bends are outstanding, in rate or amount
sufficient to provide for the payment of the principal
and interest due on such bonds in each fiscal year.

SECTION 16. Severability.

The provisions of this Act are severable and if
any provision, sentence, clause, section or part
thereof is held illegal, invalid or unconstitutional
or inapplicable to any person or circumstances, such
illegality, invalidity or unconstitutionality,
inapplicability shall not affect or impair any of the
remaining provisions, sentences, clauses, sections or
parts of the Act or their application to other persons
or circumstances. It is hereby declared to be the
legislative intent that this Act would have been
adopted if such illegal, invalid or unconstitutional
provision, sentence, clause, section or part had not
been included therein, and if the person or
circumstances to which the Act or any part thereof is
inapplicable had been specifically exempted therefrom.

SECTION 17.

The County Council hereby declares that an
emergency exists and that this legislation is
necessary for the immediate protection of the public
