in cases where the tenant has control of heat the
owner must provide heating equipment capable of
providing a minimum temperature standard during
certain months; to provide that a reasonable time
to achieve full compliance with the requirements
of this Chapter 91 shall in no case exceed a
period of four years; and to provide authority
for the County Health Officer to act in emergency
situations.
SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
FOR MONTGOMERY COUNTY, MARYLAND, That Section 91-5 of
Chapter 91, title "Housing Standards," Montgomery
County Code 1965, is hereby repealed and re—enacted,
with amendments, to read as follows:
91—5. Minimum standards for basic equipment and
facilities.
No person shall occupy as owner-occupant or
let to another for occupancy any dwelling or dwelling
unit for the purpose of living, sleeping, cocking or
eating therein, which does not comply with the
following requirements:
(a) Every dwelling unit shall contain a
room or space for the storage, preparation and cooking
of food, which shall include space for a stove or
other cooking facilities and space for dry food
storage and space for refrigerated food storage, and
shall include a kitchen sink installed. The sink
shall be in good working condition and properly
connected to a hot and cold running water system under
pressure, and a sewer system, which sink and systems
shall be installed and maintained in a manner
prescribed by ordinances, rules and regulations of the
County, or by the regulations of the Washington
Suburban Sanitary Commission, whichever are
applicable.
(b) Every dwelling shall be equipped with
a complete bathroom fixture group consisting of a
flush water closet, lavatory basins, and bathtub or
shower in good working condition and installed and
maintained in a manner prescribed by ordinances, rules
and regulations of the County. Such fixture group
shall be properly connected to an approved sewage
disposal system and to an approved hot and cold
