COUNTY LOCAL LAWS

with the provisions of Subtitle 4, "Sanitary
Landfills" of Title 11 of this Code.

(3)    Such facility shall be surrounded by
fencing and screening not less than six feet (6') in
height.

(4)    Said operation shall not encroach into the
natural one hundred (100) year floodplain of any
stream, tributary area, creek, river or natural water
course.

(5)    Plans and materials shall be submitted to
show existing and finished grades, the general
vicinity of fill collection, provisions for grading
fill on a schedule basis, time of completion of the
proposed fill, the proposed future use of the prop-
erty, and computation of floodplain area.

(6) Only waste generated within the boundaries
of Anne Arundel County shall be accepted as fill
material.

(7) In addition to complying with the
provisions of Subsections (1) through (6) inclusive,
of this Section, sanitary landfills shall be permitted
in PA — Agricultural Residential Districts and DD —
Deferred Development Districts provided:

(a)    Upon completion of the operation, the
property shall be subject to a
recreational or open space easement
by the County.

(b)    No building permit shall be issued
for any structure not to be used for
recreational purposes.

(c)    The operation shall not accept
hazardous waste (including, but not
limited to, oil products, or
pathogenic or [[combustible]]
INCENDIARY material) as fill.

(D) ONLY COUNTY OPERATED SANITARY
LANDFILLS SHALL BE PERMITTED.

SECTION 2. AND BE IT FURTHER ENACTED, That
Sections 13-303.2, 13-304.1 (2) and 13-320.2 (a) of
said Code, Title and Subtitle, Article III,
